Mooney by Governor Stephens of California, docs not in any way settle the case from the viewpoint of organized organ-ized labor, says a statement issued today to-day by Frank .Morrison, secretary of the American Federation of Labor, taking tak-ing the position that charges of perjury In connection with the conviction makes a new trial imperative. Mr. Morrison's statement follows: ,. "Organized labor will be in full ac-fcord ac-fcord with Governor Stephens' state-1 hient that: " 'It is, of course, unnecessary to urgue the point that whatever Moon-ey's Moon-ey's character or his past record might have been, this particular -case must bo determined upon its merits.' "In my judgment, however, the commutation-does not in any way settle this case. . In a letter let-ter to State Attorney General Webb on April 25, last year,. Judge Griffin, in urging a new trial, said that if the perjured evidence was presented 10 him before the case left his hands, he would unhesitatingly have granted a new trial. On November 21 of this year, Judge Griffin " renewed his request re-quest in a letter to Governor Steph-"Under Steph-"Under these circumstances every trade union movement has urged that Mooney be given a new trial. ThJs could be accomplished by the governor gover-nor pardoning him and- having him immediately im-mediately arrested on one of the other murder indictments resulting from the bomb explosion. . "As the matter now stands Mooney is to serve a life imprisonment on evi-dence evi-dence that the trial judge says 'bears directly upon the credibility of the witness wit-ness and goes on the very foundation of the truth of the story told by Ox-nian Ox-nian (the state's chief witness"), on the witness stand.'
