"Section 3. Id. On Railroads. "Section 4. Penalty of Non-compliance. An person or persons, company com-pany or corporation or railroad company com-pany In this stato falling to comply with any of tho provisions of Sections Sec-tions 1, 2, and 3 of this act shall bo doomed guilt of a misdemeanor, 'and upon conviction thereof shall be fined not less than ten dollars nor moro than three hundred dollars, said fines to be recoverod with costs In any action to be brought In tho namo of tho stato by the county In which said lands, rights-of-way, reservoirs, res-ervoirs, dams, canals, ditches, or other water courses are situated. "Section 5. Duty of County Commissioners. Com-missioners. The county commissioners commission-ers of tho several counties of this state shall at least once In each year , and oftener If deemed necessary, require re-quire the county road commissioners of their respective counties to clear the public roads In tho' county of noxious weeds and tho cost3 of the same shall be paid out- of tho county fund. And said county commissioners commission-ers shall, whenever petitioned by twonty-flvo land owners of the county, coun-ty, appoint tho county road commissioner commis-sioner ex-offlclo weed Inspector of tho countV and they shall prescribe all other duties of said weed. Inspector Inspec-tor that may bo deemed necessary for the enforcement of the provisions of this act. The actual and necessary neces-sary expenses of said weed Inspector shall also be paid out of the county fund. "Section 6, Id. Fixing Tlmo by Ordinance Tho county commissioners commission-ers may, by ordinance, fix the time for the destroying or cutting of noxious noxi-ous woods as in this act provided, and provide for the posting or publishing of notices, announcing the tlmo allowed al-lowed for such purpose, and may require re-quire that said noxious weeds bo destroyed de-stroyed oftener 'than onco in each year and may doslgnato and order tho destruction of other weeds not enumerated in the act.
