Show D & 0 Sanitation issued License As the result of action in the District Court by Judge v Pro Tem Christian Ronnow, ' Cedar City Corporation has issued a license for D & 0 Sanitation to operate a garbage collection business within the city. Sherman Dalton, owner and operator of D & 0 Sanitation stated that "it was unreasonable for Cedar City to try to keep us from obtaining a Cedar City Licease. I , believe in the competitive market system and the action of the court has proven me right. We've been just two years obtaining ob-taining the right to function as a competitive business in Cedar City," he said. Judge Ronnow in his review of the case before the District Court declared that "Cedar City Corporation had and has no power to issue any franchise granting, or to issue to any person, the exclusive right to collect or transport garbage, kitchen refuse or by-products. It may, however prescribe by ordinance that any such materials as may be deemed deleterious to the public health, may be taken by Cedar City Corporation and burned or otherwise destroyed. "The attempt to revoke D & 0 Sanitation's business license was, and is an attempt at-tempt to prohibit a legitimate endeavor, which prohibition has not been claimed or shown to bear a reasonable relation to the public health." It was further stated in the judgement that D & 0 Sanitation is entitled to the issuance of a permanent injunction, enjoining and restraing Cedar City Corporation Cor-poration from hereafter interfering with D & 0 Sanitation to conduct its lawful business. ' The statement went on to direct Cedar City Cor-. Cor-. poration "to issue D & O Sanitation forthwith and immediately, an appropriate ap-propriate business license and necessary receipts upon the completion and filing of appropriate applications and payments of appropriate ap-propriate fees." As the result of the action Dalton has announced that he has obtained a license and is now offering the services of his company to businesses who would be interested in obtaining such services. "We can haul away anything that can be put in the containers," con-tainers," he emphasized. |
