Show Sixth District Court Actions PANGUITCH Judge David L. Mower presided over a heavy court session on Sept. 17 in Sixth District Court in Panguitch. Sentencing was held for Christopher Chris-topher Henrie, 27, Panguitch for his conviction on a single count of forgery, a 3rd degree felony, reduced down from some 45 counts. Henrie had undergone a diagnostic evaluation at Utah Department of Corrections, Point of the Mountain Facility. The findings of the evaluation recommended Henrie serve six months in the county jail with no credit for time served, then enter a 6-8 month combined substance abuse program and job training in Salt Lake City entitled St. Mary's Home Program, as soon as bed space becomes available. The recommendation restitution be made to victim. Attorney Wallace Lee agreed with the findings of the evaluation. evalua-tion. In addition he asked that Henrie be subject to all search and seizure requirements and available for community service working either with Panguitch City or Garfield County. Henrie' s attorney Floyd Holm recommended he be given credit for the 132 days already served in jail, be released immediately, and complete treatment at the Horizon House in Cedar City, a 30 to 35 day program. Judge Mower sentenced Henrie Hen-rie to a term not to exceed five years in prison and a fine of $9,250. He suspended execution of the prison sentence, placing Henrie on three years probation with the Department of Adult (See COURT on Page 7A) V COURT From Front Page Probation and Parole. Henrie was instructed to would remain in jail until such time as space opened up at St. Mary's in Salt Lake City or until Henrie himself secured entrance to the Horizon House in an in-house program. If Henrie does not successfully suc-cessfully complete either program, pro-gram, he is to report back to jail. He is also required to pay restitution restitu-tion within 18 months after he is available to work full time. Wanda Lewis, 41, Loa, was in court for an initial appearance on four counts including aiding and assisting theft, a 2nd degree felony; fel-ony; aiding and assisting theft, a 3rd degree felony; criminal conspiracy, con-spiracy, a 3rd degree felony; and criminal conspiracy, a class A misdemeanor. Lewis completed an affidavit of indigence and was appointed the services of Public Defender Floyd Holm. Lewis had been released on her own recognizance with her preliminary hearing set for Nov. 12. Clifton Kent Robinson, 23, Vernal, formerly of Escalante, was before the court on an order to show cause why his probation should not be revoked. An affidavit affida-vit was signed by Probation Officer Offi-cer Richard Larsen stating Robinson Robin-son had failed to report, failed to pay fines and failed to pay supervisory super-visory fees. Robinson admitted all three allegations in the order were true but with an explanation. Tom Vuyk Prosecutor for the state of Utah could not be in attendance but had Attorney Wallace Lee stand in for him. Vuyk expressed his desire to have Robinson committed to jail to complete the remainder of his sentence. Officer Larsen expressed that he felt Robinson hasn't taken his obligations seriously, that probation proba-tion should have ended the previous previ-ous year but had to be extended. Judge Mower revoked Robinson's Robin-son's current probation and remanded re-manded him to the custody of the Garfield County Sheriff to serve a term of 90 days in the county jail. His probation was terminated as unsuccessful. Clayton Burningham, 27, Panguitch Pan-guitch was scheduled to appear on an order to show cause why his probation should not be revoked. Previously continued from Aug. 20, this case was again continued by request of Burningham's attorney, attor-ney, Robert Breeze of Salt Lake City who had other commitments. The case was rescheduled for Nov. 12. Randy Lynn Griffin, 38, Escalante, Esca-lante, was before the court for review of his sentence. Griffin's attorney, Floyd Holm had made a motion for Griffin's release. Attorney At-torney Paul Graf was not present in court but called during the proceedings pro-ceedings to protest Griffins release. re-lease. Holm pointed out that Griffin had obtained new employment with a sawmill in Escalante and was not able to satisfy child support sup-port obligations sitting in jail. Judge Mower authorized release re-lease of Griffin stating he would have to report back to jail one week later if he could not provide a W-4 form from his employment. The court was informed that a notice of appearance was received re-ceived from Jim Bradshaw on behalf of Sunny Hardy of Boulder. Robert Dwaine Laverty, 28, oi St. George, was before the court on three separate charges relating to drugs. Count one is possession of a controlled substance (marijuana) (mari-juana) with intent to distribute, a 2nd degree felony; count two possession pos-session of a controlled substance (methamphetamine), a 2nd degree de-gree felony and count three, possession pos-session of drug paraphernalia, a class A misdemeanor. Laverty's case was set for a preliminary hearing in October. Dennis D. Wintch was set on for a restitution hearing. No principals prin-cipals were present in court but both sides had mutually requested a continuance until Nov. 12. |
