STATE ENGINEER Published in Garfield County Newson April 24 and May 1, 1997 PROPOSED ADMINISTRATIVE ORDER SAFE DRINKING WATER ACT to Town of Hatch PUBLIC NOTICE The purpose of this notice is to seek comments regarding the decision de-cision by the Region VIIToffice of the U.S. Environmental Protection Agency to issue an Administrative Administra-tive Order, Docket No. 8 PWS-VIII-96-65 to the Town of Hatch, Utah. This Proposed Order is the result of the Town's alleged failure fail-ure to comply with lead and copper cop-per monitoring requirement8; failure fail-ure to comply with annual nitrate monitoring since December 31, 1993; failure to comply with nitrite monitoring due by December Decem-ber 31, 1995; failure to omply with the inorganic chemical monitoring due by December 31, 1 995; failure to comply with the unregulated inorganic chemical monitoring due by December 31, 1995; failure comply with volatile organic chemical quarterly monitoring moni-toring to be completed by December De-cember 31, 1995; failure to comply com-ply with the four consecutive quarterly radioactivity monitoring, due every four years; failure to provide public notice of noncompliance; non-compliance; and failure to report violation to EPA a8 required by the Safe Drinking Water Act (SDWA). BACKGROUND Part B of the SDWA, 40 U.S.C. Section 300g-l et seq., specifically mandates regulation of public water systems to protect the public health by assuring that safe drinking water is provided to consumers. The Utah Department of Environmental Quality administers admin-isters the SDWA in Utah, but the State has not initiated appropriate action to address violations by this public water supply. EPA proposes to issue this Administrative Order to the Town of Hatch because of violations EPA alleges have occurred at the public water supply system located lo-cated in Garfield County, Utah. The Proposed Order requires that the Town of Hatch take steps towards to-wards compliance with the SDWA and applicable regulations. regula-tions. The purpose of the public hearing shall be to determine whether a Proposed Administrative Order: (1) Has correctly stated the extent ex-tent and nature of a party'- violation viola-tion of any regulation, 9chedule, or other requirement of the SDWA, and (2) Has provided, where appropriate, a reasonable time for the party to comply with applicable requirements of the SDWA and its implementing regulations.
