PAS3-! ED BY THE ST. GEORGE CITY COUNCIL ON DECEMBER 20, 1930, AND AN ORDINANCE ENTITLED "AN ORDINANCE REQUIRING A LICENSE FROM WHOLESALERS," PASSED BY THE -ST. GEORGE CITY COUNCIL COUN-CIL ON APRIL l'l, 1934, AND ALL OTHER ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT, HEREWITH. Be it ordained by the City Council Coun-cil of the City of St. George, Utah: SECTION 1 WHOLESALERS. WHOLESAL-ERS. It shall be ' unlawful for any person, firm or corporation to engage in or pursue the business busi-ness of maintaining or operating an establishment for sale at wholesale or wholesale distribu-! distribu-! tion. of any of the following lines nf mprnli a n r? iA nmninlHoo n. personal property within the corporate cor-porate limits of St. George City without first obtaining a license so to do, to wit: Fruits, vegetables, bread, pastry, pas-try, bakery products, crude petroleum, pe-troleum, or its products, flour, feeds, grain products, canned goods, dry goods, tires, automobile automo-bile accessories, cement, plaster, soda water, soft drinks, groceries, gro-ceries, candies, and confections. I3ECTION 2 DEFINITION. The phrase "the business of operating op-erating or maintaining an establishment es-tablishment for scale at wholesale whole-sale or wholesale distribution" as used in this ordinance shall include the transactions or ac- tivities of any person, firm or corporation in any building, storeroom, wagon, truck or other vehicle, or on any vacant lot or stand in keeping, storing, packing pack-ing distributing, or offering for sale at wholesale . any of the lines of merchandise, commodities, commodi-ties, or personal property named in Section 1 of this ordinance provided, that the provisions of this ordinance shall not apply to any person, firm or corporation corpora-tion engaging in or pursuing the business of maintaining or operating opera-ting an establishment for sale at wholesale or wholesale distribution dis-tribution of any commodities or produce grown by them. SECTION 3 LICFNSF v,r person, firm or corporation maintaining main-taining and operating an establishment es-tablishment for sale at wholesale whole-sale or wholesale distribution as defined in this ordinance shall first obtain a license from St George City so to do. The annual an-nual license shall be $30.00 per year, shall be payable in advance and shall expire on the 31st day of December of each-, year, provided, pro-vided, however, that the license tee for the year 1934 shall be one-half of the annual license set out herein . SECTION 4 PENALTY. Any person, firm or corporation maintaining main-taining and operating an establishment estab-lishment for sale at wholesale or wholesale distribution as in this ordinance defined, without first procuring a license so to do as provided for herein, shall be guilty of a misdemeanor and upon up-on conviction shall be punished by a fine in any sum not exceeding exceed-ing Two hundred ($200.00) Dollars, Dol-lars, or by imprisonment for any term not exceeding one hundred days, or by both such fine and imprisonment. SECTION 5 RECEIPTS. All money paid into the city treasury under the provisions of this ordinance shall be placed to the credit of the ordinary city rev- enue to be disbursed in the same 1 manner as the funds demed vom the usual course of taxa tion for such account. SECTION 6-CONSTITUTION- ALITY. If any section or pro-vision pro-vision of this ordinance shall be adjudged unconstitutional or m-j valid for any reason such adjudication ad-judication shall not effect the validity of this ordinance as a whole or of any section or provision pro-vision thereof which is not specifically spec-ifically so adjudged unconstitutional unconstitu-tional or invalid. SECTION T REPEAL. An ordinance entitled "An ordinance requiring a license for distribution distribu-tion of crude .; petroleum or :ts products and for acts not otherwise other-wise provided for" passed by the St. George City Council on December De-cember 20, 193.0, and an ordinance ordin-ance entitled "An ordinance requiring re-quiring a license from wholesalers" wholesal-ers" passed by the St. George City Council on April 14, 1934. and all other ordinances or parts of ordinances ;in conflict herewith here-with are hereby repealed. SECTION 8 This ordinance shall take effect at the expiration of the thirtieth day after its final passage. "- Passed by the City Council of St. George City on the 4th day of August, A. D., -19 3 4.
