CON-STRUCT. OPERATE AND MAINTAIN A STANDARD GAUGE RUN - AROUND RAILROAD TRACK OVER BUDGET PRICED COMMERCIAL PRINTING The Times - Independent AND ACROSS DEAD HORSE POINT ROAD IN THE NORTHWEST QUAR- j TER OF SECTION 2, TOWN- ' SHIP 25 SOUTH, RANGE 20 EAST, SALT LAKE BASE AND MERIDIAN, IN GRAND COUNTY, STATE OF UTAH. THE BOARD OF COUNTY COUN-TY COMMISSIONERS OF GRAND COUNTY, STATE OF UTAH, ORDAINS AS FOLLOWS: Section 1. A franchise ' and right of way is hereby given and granted to The Denver and Rio Grande Western Railroad Company, its successors and assigns, to construct, operate and maintain a standard gauge run-around railroad track over and across Dead Horse Point Road in the Northwest North-west Quarter of Section 2, Township 25 South, Range 20 East, Salt Lake Base and Meridian, in Grand County, State of Utah, all as shown in yellow on the attached print, which is hereby referred re-ferred to and made a part hereof. Section 2. During the term of this franchise the grantee gran-tee shall be subject to the following conditions: (a) Said track shall be laid upon and conform to the grade of said road and shall at all times be maintained main-tained by the grantee to conform to the grade of said Road; and if said grade is afterward changed by ordinance of the Board of County Commissioners, the grantee shall, at its own expense, change the elevation eleva-tion of the track so as to conform to the same. (b) Grantee shall put in and maintain such crossings cross-ings over said track as shall from time to time be required re-quired by the Board of County Commissioners. (c) Said track shall be i laid and the railroad operated oper-ated so as to cause no unnecessary un-necessary impediment to the common and ordinary use of said Road upon which it is laid, and grantee shall repave, resurface or repair between the rails with the same kind of material ma-terial used on the said Road or with such other material mater-ial as may be approved by the Board of County Commissioners. (d) Good and sufficient pipes to convey water shall be laid and maintained in good condition at the expense ex-pense of the grantee in all water ditches crossed by said track so as to admit of free passage of water. Section 3. Nothing in this grant shall be so construed as to prevent the Board of County Commissioners or its authorized agents from paving, laying water or sewer mains, ditches or pipes, or altering .repairing or in any manner improving improv-ing said Road, but all such improvements shall be made with as little injury as practicable t0 said track and the operation of railroad rail-road facilities thereon. Section 4. This franchise is granted for a period of fifty (50) years from and after the passage of this ordinance. Section 5. This, grant and all the terms and conditions condi-tions thereof shall be accepted ac-cepted in writing by the grantee within thirty days after the passage of this ordinance, otherwise the same shall be void and of no effect. Section 6. This ordinance shall take effect fifteen (15) days after the date of its passage upon publication as required by law.
