Williams of West Jordan nreeinct, Sheriff Frank Em-'ery, Em-'ery, Albert Hunt and the United States ' -Smelting company, for (650 damages for, as the complaint alleges, "unlaw-, ' fully and -wantonly depriving the plaintiff plain-tiff of his earnings." This is, accord Ing to the complaisant ' allegations, another an-other instance of the nefarious practices prac-tices of the Luke concern. Garside sets forth that on the 9th of February there was wages due him amounting to $112.15 from the Smelting company, but the company refused to (pay him. In March, 1904, the defend-.ant defend-.ant Hunt procured a Judgment in the Justice's court of West Jordan for 150.38 against the plaintiff. But Garside Gar-side avers that in November, 1904, ha became a bankrupt, and that in July, 1905, he was duly discharged as such bankrupt in the Cnited States District court, and that Hunt was listed as a creditor in that proceeding. In February, it -is alleged that the defendants wantonly and unlawfully had an execution issued against him and delivered to Sheriff Emery for service. On. the 20th of February the Sheriff received $100 from the Smelting company, the earnings of the plaintiff, without his knowledge or consent, and that the money was delivered to the Luke concern, as attorney for Hunt. It is alleged that all the defendants concerted against him to deprive him of his earnings, and now he snes for $150 actual damage and $500 exem- Flary damages. Tribune, March 24, 907.
