Thaw. NEW YORK, March 25. Counsel for Harry K. Thaw, with the exception of D. M. Delmas, were in court before noon today to take whatever action is possible to convince J ustice Fitzgerald that their client is not insane. Thaw's wife and mother, his brother Josiah, and his sisters, sis-ters, the Countess of Yarmouth and Mrs. George L. Carnegie, Car-negie, also were in the courtroom some time before Justice Fitzgerald arrived. After waiting in court a short time Thaw's counsel were informed that Justice Fitzgerald would not reach the courtroom until 2 o'clock. It is stated today that if a commission commis-sion In lunacy is appointed, Thaw will not take advantage of legal devices to thwart a thorough examination by such a commission. He is said to be eager for a chance to prove that he is sane. Thaw-is credited with saying: "I will submit to all phases of an examination that Is rational and reasonable." rea-sonable." . , Thaw is not convinced that Justice Fitzgerald will find it necessary to appoint ap-point a commission in lunacy, - but he resents the possibility pf the general public inferring from the fact that his own counsel opposes District Attorney Jerome's move for tho appointment of a commission, that he shrinks from the ordeal of facing such a body. 1 Thaw is in high spirits over the affidavits affi-davits drawn in his behalf and delivered to Justice Fitzgerald. He is especially pleased with the affidavit prepared by his mother. On the other hand, District Attorney Jerome is confident of the appointment of a commission and an adjournment of court Wednesday until the commission commis-sion can prepare its report. Jerome, it is stated, will not add to the array of affidavits which he has placed already in Justiee Fitzgerald's Hands. Counsel for Thaw and the members of his family again appeared in court at 2 o'clock to await the opening of conrt. Justice Fitzgerald had not arrived ar-rived at 8 p. m. When Justice Fitzgerald appeared on the bench, he merely went through the formality of adjourning, the case until Wednesday at 10:30. - THAW MAKES A THIRD STATEMENT TO NEWSPAPERS . NEW YORK, March 25. Harry K. Thaw last night made public another statement, this time denying a rumor which he believes to be current to the effect that there is a dissension among his counsel. He also refers to the affidavits affi-davits filed with Justice Fitzgerald by his attorneys in opposition to the appointment ap-pointment of a, lunacy commission to examine him. A. Russell Peabody, who gave the matter to the press after he had had a conference with other members of Thaw's counsel, designated it as "the third statement issued by Thaw since August 10 last." It follows: "I wish to deny the rumor that there is dissension among my counsel. coun-sel. "Owing to the limited time affidavits affi-davits were prepared simultaneously at the office of Mr. Delmas and of Messrs. Hart ridge and Peabody. Four that were completed March 22 at the latter office of-fice were transmitted to the former, snd all of that date were printed together to-gether under Mr. Delmas' supervision. "Those made March 23 were brought to me, as I was nearest the court. "I examined the last four from Messrs. Hart.ridge and Peabody and one from Mr. Delmas' office, and found tbem eminently satisfactory. "This method was sanctioned by Mr. Delmas. Had I considered that" anything any-thing in the last affidavit might be considered inappropriate for this occasion occa-sion it would have been withdrawn for the time and corrected under Mr. Delmas' Del-mas' direction. "My mother sent her exceedingly clear affidavit Friday morning to be copied at the office of Jfartridge and J Peabody, and proceeded there later to affix her signature under oath. "It was written by her at her hotel with no suggestions from any one whomsoever, and is filed exactly as she prepared it." The monotony of Thaw's Sunday at the Tombs was'broken by an unexpected visit from his wife. This was the first time since his detention that the 1 prisoner was allowed to receive callers other thsn bis counsel on Sunday. Mrs. Thaw said: "Harry is in excellent health snd is sure that everything will come out in his fsvor. " |
