As a trusty, he was working In the prison orchard and succeeded In escaping es-caping and remained at liberty for three days before ho was- located in Salt Lake and returned to Warden tieorgo A. Sforrs. In papers filed In the Third district court yeslerday. Shadlow alleged tjiat he was not present In court when the Jury announced Its decision. He asked for a writ of habeas corpus aa a means of obtaining his release. The case will be heard before Judge W. M. Mct'rea, who will succeed Judge Strlngfellow as one of the Judges of the third district. Shadlow'a case was tried before Judge John V. Tobin last June an resulted In a conviction for third degree de-gree burglary. The verdict was ren- I dered lata at night, and through some 1 error. Shadlow was not present when the Jury reported. He Is said to have waived his right to be present when he appeared the following Saturday for sentence. Since his confinement In the prison, Sliadiow is said to have written several sev-eral letters to members of the Jury which convicted him. protesting that he was wrongfully convicted and asking ask-ing "what constituted the charge as he had never been Informed."
