Show MAY GRAZE STOCK ON INDIAN LANDS According to an opinion delivered yesterday by Judge Marshall of the United States court, the act of Congress Con-gress passed in 1834 prohibiting tbe grazing of stock on Indian lands has become untenable. The opinion was given in ruling on the demurrers to the indictments against Albert Smith and Jessup Thomas, who were ebarged witl grazing stock on Indian lands. The reasoning of the court was that the act was passed for the purpose of preventing acts which would provoke reprisals on the part of the Indians. Since the Indiana have been granted citizenship and freed from their tribal government they are now amenable to the criminal laws of the State wherein they reside. For that reason the law la declared to be inoperative. ( |
