Hilton in whjch she asked that she be paid $10,400 out of the Park estate as her dower right in property sold by Dr. M Park in his lifetime. - It will be remembered that shortly after the death of Dr. Park, some years ago, Mrs. Hilton- brought suit against the estate, es-tate, alleging that she was married to the doctor many years ago and that the marriage mar-riage was still In force at the time of his death. Her claim was sustained by the courts, and she was granted a dower right in the estate. During his lifetime, however. Dr.' Park disposed of considerable real estate; it ; as this property which formed the basis ba-sis of Mrs. Hilton's recent petition in which she alleged that she was the "own-: "own-: er of and entitled to one-third Interest In eackt and all of the several parcels of real cstAte. as the surviving wife and widow of decedent." ydge Armstrong held the demurrer ' - rod aa to the paragraph in the petition a. ieging that she was the "owner" of one-; one-; Wrd. but denied the motion to strike out yftae paragraph.
