Benson, who, la not yet 17 years old. . and who ,ia charged with, robbery, waa arraigned before Judge .Dlehl this morning Xor the, purpose of taking his plea. Attorney Arthur B. Chrlstensen, representing the defendant, objected to the Jurisdiction of the court, under the provisions of the-recently enacted Juvenile Juve-nile court law, contending that the age of the defendant was a bar to the Jurisdiction Jurisdic-tion of the court in his case. ' Judge Dlehl sustained the objection, and a motion to transfer. the case to the Ju -venlle court was also sustained. . Should the Juvenile court refuse to. assume as-sume Jurisdiction in the case, as It Is understood un-derstood will be done. It is the Intention of Attorney Chrlstensen to test the question ques-tion of Jurisdiction by habeas corpus proceedings. pro-ceedings. Benson is charged with a felony. It Is alleged that he and William Moorhead held up and robbed F. O. Heymond on .the night of March 26. Moorhead pleaded guilty to the charge and waived his preliminary pre-liminary hearing In the lower court, and his trial has been held In abeyance until the status of Benson's case is determined. |
