ORDINANCE NUMBER 86 AN ORDINANCE OF THE CITY OF SPRINGVILLE, UTAH, LEVYING A SPECIAL TAX AND MAKING THE AS-SESSMENT UPON THE PRO-PERTY LYING IN IMPROVE-MENT DISTRICT NUMBER 10 FOR THE PURPOSE OF PAYING THE COST OF CON-STRUCTION OF CURB AND GUTTER AND SIDEWALK INSTALLED THE REIN, WHICH PROPERTY BENE-FITED BY SUCH IMPROVE-MENTS AND SO ASSESSED ABUTTS UPON CERTAIN STREETS WITHIN THE COR-PORATE LIMITS OF THE CITY OF SPRINGVILLE, UTAH, DESIGNATED IN SECTION 1 OF THIS ORDIN-ANCE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SPRINGVILLE, UTAH: SECTION 1. For the pur-pose of paying the cost of construction of curb, gutter, sidewalk and incidental im-provements installed and com-pleted as authorized by Spring-ville City Ordinance Number 82, passed September 17, 1962, there is hereby levied a spec-ial tax which is assessed upon the property in Improvement District Number 10 as such property is particularly des-cribed in the Tax List of said district hereinafter adopted and approved, which property is herein designated in general terms and abutts upon the fol-lowing streets in the city of Springville, Utah, to-wi- t: SIDEWALK IMPROVEMENTS: 300 SOUTH STREET south side between Main Street and 100 West Street. The property assessed is also a part of and located within the following described tracts of land, t: Part of Blocks 4, 5, 6, 7, 11, 26, 29, 30, 35, 36, 43, 44, 53, 54, 58 and 63, of Plat A, Springville City Sur-vey of Building Lots; Lots 8 through 16, inclu-sive, of Canyon Drive Sub-division, Springville, Utah; The Southeast quarter of the Southwest quarter of Sec-tion 33, Township 7 South, Range 3 East, Salt Lake Base and Meridian; The Southwest quarter of Section 34, Township 7 South, Range 3 East, Salt Lake Base and Meridian; The North half of the Northeast quarter of Section 3, Township 8 South, Range 3 East, Salt Lake Base and Meridian; The Northwest quarter of the Northeast quarter of Sec-tion 4, and the Southeast of the Northwest garter of Section 4 Town-ship 8 South, Range 3 East, Salt Lake Base and Meridian. The taxes levied and assessed the cost and ex-penses are to defray of constructing side-walks, curb and gutter, drive-ways, necessary drainage sys-tems and all other things re-quired to properly complete the work on the streets above de-signated; and said taxes are assessed against the parcels of land especially benefited and affected by the improvements made.' It is hereby adjudged determined and established that each parcel of land so assessed will be especially benefited by the improvements constructed and installed adjacent to each such parcel to the full amount of the tax levied, and that the tax is assessed at an equal and uniform rate, according to the type of improvements installed, upon the property fronting or abutting on the streets so im-proved and adjacent to such improvements to the entire depth back from the street line but not exceeding a depth of 165 feet. The total tax hereby levied and assessed upon the parcels of land fronting or abutting on the streets so improved and nt to such improvements is the sum of $53,354.98, which sum is segregated for assessment purposes as follows: The curb and gutter portion is divided into the following s: (A) The type 1 curb and gutter portion is $23,-718.2- 1, there being 8,531.73 linear feet of assessable front-age assessed at the uniform rate of $2.78 per front foot. (B) The type 3 curb and gut-ter portion is $9,007.82, there being 3,043.185 linear feet of assessable frontage assessed at the uniform rate of $2.96, and $735.00 for 21 irrigation turn-outs assessed at the rate of $35.00 each. (C) The bridge type driveway portion is 8, there being 413.50 linear feet of bridge drive assessed at the uniform rate of $3.85 per linear foot, and 180.38 square yards of 6 inch driveway con-crete assessed at the uniform rate of $3.42 per square yard. (D) The open type driveway portion is $4,084.86, there being 99.00 linear feet of open face driveway 4.5 feet in depth as-sessed at the uniform rate of $1.81 per linear foot, 590.50 linear feet of open face drive-way 5.0 feet in depth assessed at the uniform rate of '$2.00 per linear foot, 53.0 feet of open face driveway 12.5 feet in depth assessed at the uniform rate of $4.94 per linear foot, and 415.0 feet of open face driveway 15.0 feet in depth as-sessed at the uniform rate of $5.99 per linear foot, together with $342.39 for extra concrete and steel assessed against the particular parcel of land bene-fited. The sidewalk portion is 7, there being 4,162.20 lin-ear feet of 4 inch sidewalk assessed at the uniform rate of $1.75 per front foot and 548.50 linear feet of 6 inch sidewalk assessed at the uniform rate of $1.99 per front foot, together with $32.00 for additional ex-cavation assessed against the particular parcel of land ben-efited. The total tax in the amount of $53,354.98 is the cost of the abuttors' portion of said improvements according to the contract entered into for the performance of said work ana the making of said improve-ments with Bouchard and Stark dated September 17, 1962, to-gether with an amount equal to but not exceeding ten per-cent (10) of said cost to cover the actual cost of en-gineering, inspection, publish-ing and mailing notices, mak-ing the levy and miscellaneous services performed in connec-tion therewith, which is added thereto as provided by law. The Springville City Treasur-er is hereby authorized and directed to assess and collect the said tax in accordance with the provisions of law and ord-inance. SECTION 2. The Tax List for Improvement District Num-ber 10, as corrected, approved and completed by the Board of Equalization and Review, which Tax List has been filed with the Springville City Recorder and which particularly des-cribes each parcel of land upon which said taxes are levied and assessed, setting out the name and address of the owner of each such parcel and specify-ing the amount of tax assessed against the same, is hereby adopted, confirmed and ap-proved, and the assessments made and returned in said com-pleted Tax List, and the report of the Board of Equalization and Review, to the Springville City Council are hereby adopt-ed, ratified, approved and con-firmed. SECTION 3. The said special tax shall be due and payable in ten (10) equal annual in-stallments, as provided by law and ordinance, with interest on the whole amount of said tax unpaid at the rate of five per- cent (5) per annum from the effective date of this ordin-ance, payable at the time each such installment is due- - pro- vided, however, that one or more of such installments or the whole tax may be paid without interest within fifteen (15) days after this ordinance becomes effective, and one or more of said installments in the order in which they are payable or the whole tax un-pa!- d may be paid on the date any installment is due by pav-ing the amount thereof plus interest to said day. The said Special Tax is due and payable in ten (10) equal annual installments. The first such installment, plus interest, is due and payable on Septem-ber 15, 1964, and a like in-stallment, plus interest, shall be due and payable on Septem-ber 15th of each year there-after until said special tax has been paid in full. Interest upon the whole amount of said tax unpaid at the rate of five per-cent (5) per annum from September 15, 1963, to the date of payment is payable in addi-tion to and at the time of the payment of each installment; PROVIDED, however, that one or more of such installments or the whole tax may be paid without interest on or before September 30, 1963, and one or more of said installments in the order which they are pay-able, or the whole tax unpaid, may be paid on the date any installment is due by paying the amount thereof plus in-terest to said day. Such tax will become delin-quent if any installment of the principal or interest thereof is ' not paid on or before the date when the same becomes due and payable. In such event the whole amount of the tax un-paid at the time of such de-fault will become immediately due and payable, and win draw ' interest at the rate of ten percent (10) per annum until paid, and in such event the property against which such tax is levied and assessed will be sold for the delinquent tax, interest, penalty and costs as provided by law and ordinance.
