Show SICKLY TQMflTOES GUILTY OF DEFAULT Judge Orders Destruction of 25 Cases When They Fail to Appear in Court. Having been canned in New York while extremely ill, tossed about and badly treated on the ."journey from New York to Sail. Lake, ,and finally having been seized by the pure food and drug" inspector upon arrival here, the twenty-five cases of tomatoes against which tho United States started suit July 1, did not have the nerve to appear in court 3'csterday. Instead, tho tomatoes stayed awar and committed default. As a result they will bo burned at the stake by the Unicd States marshal under orders from Judge John A. Marshall. The defendants wore shipped from New York April S by tho Jgnatus Gross company, consigned to N. K. Vassilacopoulos of this city. Upon tboir arrival in Salt Lake they were seized by the D. & E. G. Railway company. com-pany. Then the federal inspector got busy and learned that th'e tomatoes branded on the cases as first class were "filthy, decomposed and putrid vegetable substances." A complaint was filed by the United States district attorney aiid the shippers were ordered to appear in court and exhibit the contents con-tents of six cans from each case.
