Show GRANT CASE CAN BE CARRIED HIGHER Judge M. Is. Ritchie Indicates Method of Finally Disposing of Contempt Con-tempt Oharg; So as to give- opportunity for a final settlement of the caso, Judge M. L. Ritchie of the district court yesterday modified his decision in the prohibition prohibi-tion proceedings against Harry S. Harper, -justice of the poacc, instituted by Chief of Police B. F. Grant to pro-vent pro-vent Harper from proceeding with contempt con-tempt charge? against the chief. Tudgo Ritchie held in his original decision that the justice acted without authority in issuing an ordor which the chief of police disobeyed, and 'for which he was cited for contempt. The modification entered yesterday strikes out tho order prohibiting the justice of tho peace from proceeding with the contempt case. Justice Harperjs now free to call the chief of police into his court and go on with the contempt proceedings. Judge Ritchie's opinion indicated that tho proper legal procedure would bo for Justice Harper to call the chief into court and then dismiss the contempt con-tempt proceedings. Justice Harper last night said that Chief Grant would have to stand trial for contempt and that summonses wcro issued yesterday, aud iff all wore served in timo tho cases would be called Thursday morning. |
