KANSAS CITY, Feb, 10 As a climax cli-max to" the lengthy investigation of the mysterious death of Colbncl Thomas H. Swope on October .', 3909, Dr. B. C. Hj-de. husband of tho late millionaire's niece, was arrested today on a charge of murdering tho aged philanthropist. The warrant upon which the arrest was made was issued at the request of Attorney John G. Paxton, executor of the Swope estate. First degree murder is charged. The warrant says that Dr. Hyde with felonious intent administered adminis-tered strychnine 1o Colonel Swope on the day of his death. Across the back of the complaint filed by Mr. Pnxtou asking for a warrant, war-rant, Prosecutor Virgil Conkliug wrote above his signature, "J hereby indorse this complaint." Hyde Quietly Submits. Dr. Hyde learned that a warrant was being sought, and with his attorneys attor-neys went to the prosecutor's office to await the return of Mr. Conkling. lie submitted to arrest without demanding to hear the warrant read. From there the party went to Independence. Mo., whore Dr. Kydo was arraigned before .Iustice W. F. Lorir. The plrysieian pleaded not guilty. He wds released on a bond of $50,000. His prclimiuary hcaring was set for February 17. Prosecutor Conkling origjnally planned to have the bond fixed at $25,-000. $25,-000. But Hyde's attorneys bad arranged ar-ranged for a $50,000 surety, and. as they expressed a willingness to give this amount it was accepted. Furnishes Good Bond. The bond was signed by IP. V. Ncal. president of the Southwest National bank and IT. F. Hall, president of tho Hall Baker Grain company;' M. D. Cruggs, a live stock dealer: William McLaughlin, .1 borseman. and John G. Clcary, Frank P. "Walsh and Judge John Lucas, attorneys. These are all wealthy. The calmest man iu tho .-justice's office of-fice in Independence was Dr. Hyde. While attorneys busied themselves making-out papers iu the case and the few spectators vied with one another for a view of the accused physician, he sat near County Marshal Joel Mayes, who made tho arrest, and read a newspaper newspa-per that, fold of developments in the owope investigation. "By the way, Mr. Mays," he said, folding u)i the paper. "1 wish you wouhl call up my houso and have my wife informed that I will bo home for dinner. She will bo worried about me." Just as soon as tho bond was accepted. ac-cepted. Dr. Hyde hurried to his home in an automobile. Sequel to Grand Jury Work. The arrest followed quickly after Judge Italph S. Latshaw called" a grand jury today to investigate tho death of Colonel Swope. Prosecutor Conkling made a request for a ,iury. By dismissing his libel suit, for $600,-000 $600,-000 against Attorney John G. Pnxtou, Dr. Frank L. Hall iind Dr. Fdward J. Stewart today. Dr. Hyde removed himself him-self from I ho range of the attorneys who have been using every legal means known to them to get his depositions in the case.
