Judge Whltaker of the city court held that the city was an accomplice arid discharged Cappuclo, Thursday. The evidence showed that tho policeman police-man furnished McKnnless with the money and sent him Into Cappuclo's place to buy tho liquor nnd then arrested arrest-ed Cappuclo for soiling liquor Sunday. Under the complaint there was no other oth-er charge of violating the lnw and as the court hold that the city was an accomplice, ac-complice, tho case was dismissed and Cappuclo was discharged.
