Was Gcorgo J-'ryc (he lessee of the room adjoining his saloon in which a game of poker-was being played, on tho evening of November Novem-ber 20, which resulted in Charles Van Xoy's arrest for running a gambling room, and (ho revocation of .Fryc's retail re-tail liquor license by the city council? coun-cil? This is a phase of tho con(rovcrsy which arose in tlio police court this morning when Fryo was put on trial, charged with permitting gambling in his place of business. Without allowing allow-ing Krye, the proprietor of tho Globe saloon a hearing, the city council, two weeks ago, revoked his liquor license upon the recommendation of Mayor A. L. Brewer and the legal advice of City Attorney James Dovine. Frye immediately applied to the district court for a'restraininir order against the city authorities prohibiting them from taking any action to close up his place of business. The order was issued by the district court and December was set for a hearing, when the mayor and councilincn arc ordered to be present, and produce the records of the council coun-cil pertaining to the revocation of the license. After ascertaining that (he ordinances of the, city give Frye the right to be heard. City Attorney Dcvine, at last niuht 's session, advised the council. .through a communication, to this effect, ef-fect, and upon his suggestion, next Friday evening was set for the hearing, hear-ing, at which Frye has been requested to be present. The trial of Frye in the police court this morning wns not completed and an adjournment was taken until tomorrow to-morrow morning". It. however, developed devel-oped during the examination of witnesses wit-nesses this morning that there is considerable con-siderable doubt whether Fryo was the less-ee of the room in which the game of poker was being played. "Walter Grili'in. the lessee of the Lone Star barber bar-ber shop, adjoining the Globe saloon, testified that the small room at, the rear of his shop is also iu eluded in his lease. The room in question wns sublet sub-let to "lVilIy': Jordan several months ago. and that Jordan paid the rent up lo September .'50.- Frye, the witness, declared paid the rent for Jordan the following mouth, but stated at the time that he Jiad no-use for the room. The rent for November has not. been paid on the room, and Griffin testified that the porter of the barber shop kept the kev. 'Fhe fact that the room where the gambling game was raided by tho police has but one door, which leads into the Globe saloon, has led to the assumption that it was under the control of the proprietor. The citv has thus far been unable to prove that Frye. had charge of the room, but other witnesses havo been summoned sum-moned to appear in court tomorrow morning. |
