Show HARRIMAN STILL IN THE FIGHT TRENTON, N. J., June 6 Counsel for Edward H. Harrlirttin and "Wlnslow S. Pierce today filed In the United States Circuit court a second amended bill in tho suit brought by them to restrain re-strain the carrying out of the proposed pro rata plan nf distribution of the assets as-sets of the- Northern Securities company. com-pany. The amendments arc Intended to meet the points raised at the recent argument of the case befcre Judge Bradford. Counsel for the Northern Securities Se-curities company at that time insisted that Harrlman and Pierce, through J. P. Morgan &. Co., had fold their Northern Pacific stock outright, and that they had no equitable right to have the stock returned to them. Counsel for Harrlman and Pierce had argued that in consequence of the Supreme court's decision against the Northern Securities company the stock of tho Northern Pacific Pa-cific company had never legally passed to that company. It l.s averred that it was well-known to all concerned that the Northern Securities company was formed solely for the purpose of acquiring acquir-ing and holding the stock of the Northern North-ern Pacific and Great Northern roads and operating these roads jointly, and that this understanding conatltuted in law the Northern Securities company as custodian of the stocks of the two railroads rail-roads of the original owner rather than an absolute owner Itself of the stock. |
