' The accident by which Burch sustained sus-tained the personal Injuries described took place October 26, 1003, when he wan employed by the Southern raclflc company com-pany as a switchman In Its yards at Winnemucca, New Burch asserts that when attempting to ascend the steps of a moving caboose he Avan caught by a defective switch stand, which dragged him from the car and threw him under the wheels, Ills left leg and right foot having been run over and so badly crushed that the amputation of the leg, above the knee, and three of the toes of the foot, became necessary. He alleges that he had repeatedly warned the company of the defective condition of the switch stand which caused the accident, but it had neglected to have It repaired. |
