Show WADE ON TRIAL ON MURDER CHARGE Four Jurors Secured in the Case of the Man Heldt for the Donth. of a Chinese Ccok. FOUR jurors have been- secured in the murder case of James H. Wade, whose trial was begun in the criminal division of the District Dis-trict court yesterday. The defendant is belnc tried on the charge of murder In the first degree, for killing Lee Qucn Tou, a Chinese cook, nt Alta, on December De-cember 19, 1902. From the questions asked by the attorneys for the defend-end, defend-end, the prisoner's derensc will be that of justifiable homicide. Good progress was made yesterday in the oase, four Jurors being acceptable to both sides out of thirteen examined. Tho names of the Jurors chosen are as follows W. H. Atwood, Big Cottonwood; Cotton-wood; Richard L. Shannon, Salt Lako City; 'Ralph P. Sharkey, Murray, and John J. Toronto, Salt Lake City. Of the remaining nine jurors examined, se-en were excused on peremptory challenges, four by the State and three by the defense, and two were excused upon challenges for cause, one by tho prosecutIon and one by the defense. Nature of the Charge. The defendant Is charged with having hav-ing shot the Chinuman down in cold blood and the officers have witnesses who they say will testify that the Eth-oplan Eth-oplan was attending to his duties and never even saw Wade when he leveled his revolver and Bhot him In the eye. The defense will attempt to prove that the chinaman was coming after Wade with a long butcher-knife when tho shooting took place. Just prior to tho tragedy, It is understood that the Chinaman China-man had some words with a boy In tho iboardlng-house and that Wade look the young man's part, but that the cook was guilty of no asault or attempted assault when he was killed. The defendant Is represented In tho trial by Attorneys Frank J. GUstln, J. A. Largent and Edward McGurrin. Attorney At-torney E. B. Crltchlow, who has been retained by the Chinese government, Is assisting District Attorney Benner X Smith in the prosecution of the caso.
