Hayes, solicitor of Internal In-ternal Revenue, has gone to Chicago to represent the Government Gov-ernment In the trial of the case of W. J. Maxley, a corporation, vs. Hertz, collector col-lector of Internal revenue. The eoso Involves about 535,000 and the decision In that will control in other cases in which the revenue Involved is over a quarter of a million dollars. The oleomargarine law taxes oleomargarine oleo-margarine two cents per pound, with a proviso that any oleomargarine that Is free from artificial coloration that causes It to look like butter of any shade of yellow, shall only be taxed one-fourth of a cent per pound. Some few months ago Commissioner of Internal Revenue Yerkes decided that palm oil, although named as one of the constituent parts of oleomargarine, was an artificial coloration and that oleomargarine which contained palm oil must pay tho higher rate of tax. There are but two questions Involved In the caso. One is whether, by Congressional enactment, a judicial power mny bo vested in an administrative ad-ministrative office of tho Government and the other whether palm oil, being a natural vegetable oil, is an artificial coloration. The testimony in tho case was taken last February and the argument will be heard Monday and Tuesday, before Judge Grosscup, circuit udge. |
