Show TKUSTBI'S BALE WHEREAS, HENRY Denhalter, Frank Hoffman and Lottie L. Hoffman, his wife, on the 13th day of February, 1892, made, executed and delivered to W. 8. Mc-Cornick Mc-Cornick their certain promissory note, for the principal sum of tea thousand ($10,000) dellars, payable to the order of the said W. S. MoCoraict, sixty (60) daya after date, with interest thereon at the rate of one (1) per cent per month, payable monthly from date until paid, both before and after judgment, and Whereas, To secure the payment of said note, the aaid Henry Denhalter. Frank Hoffman and Lottie L. Hoffman, his wife, on said day made, executed and delivered to Josiah Barnett, as true-tee true-tee for the said W. S. McCornick, their certain trust deed in writing of tbat date, which, said trust deed was daly certified, acknowledged and recorded in the office of the county recorder of Salt Lake county, Utah territory, on the-17th day of February, 192, at tea rateutee past 10 o'clock, a.m., in book "3D" ot mortgages, on pages 44V&, and thereby conveyed to aaid Barnett ithe follow- ing mining property, to wit: "All those certain pieces or parcels of mineral land, situate, lying aai being in the West Mountain Mining district, county of Salt Lake, territory of Utah, boetoded and described as follows, fol-lows, to-wit: The Highland lode and mining claim, the North Eldorado lode and mining claim, the South Eldorado lode and mining claim, the Oquirrh lode and mining claim; also, all machinery machin-ery situated on said mining claims, and all buildings build-ings and improvements owned by aaid first parties, par-ties, together with the Highland boarding house, situated on the opposite side of the lawn from the Highland mine; the above described premises ia intended to Include all the interests off the parties of the first part, abeve mentioned, in and to tho Highland group of mines, situate in said mining district;" and. Whereas, it is provided in said trust-deed, that in case default be made in the payment of said promissory note, or any part thereof, or of any interest that may accrae thereon, as the same became be-came due and payable, that the said trustee might proceed to sell said described property, or any part thereof, at public vendue to the highest bidder bid-der for cash, (either of the parties hereto being at liberty to become the purchaser at such sale,) at the south front door of the connty courthouse, in Salt Lake city, Utah, first giving twenty (20) ' public notice of the time, terms and nlaee of said sain. and the property to be sold, by advertisement in some new-paper printed in the English language, and published in said Salt Lake City, in the county and territory aforesaid, and Wherbas, No payments ot principal have been made upon said note, and the whole thereof with interest from September 13, 1693, is no past dne and owing. Now. therefore, at the request of W. S. McCornick, McCor-nick, the legal holder and owner of said note, and by virtue of the power and authority in me vested nnder snd by the terms of said deed ef trust, I, Josiah Barnett, trustee as aforesaid, will on Monday, Mon-day, the 21st day of November, 1892, at the hour of 10 o'clock a. m., at the south treat door of the connty courthouse, in the city of 8slt Lake, county of Salt Lake and territory of Utah, sell the said real property, with the appurtenances, appurten-ances, together with the Highland boarding board-ing honse and all the machinery and buildings -situated thereon, belonging to said first parties, and hereinabove and in said deed of trust fully described, and all the right, title, benefit and equity of redemption ot the said Henry Denhalter, Den-halter, Fran Hoffman and Lottie L. Hoffman, his wife, their heirs and assigns therein, at public vendue to the big bent bidder for cash, for the purpose: pur-pose: 1st To pay the expenses of this trust, including in-cluding reasonable attorney and counsel fees, and compensation to said trustee for his services. 2nd Pay the amount to the holder of said promissory prom-issory note that he may have advanced for taxes, insurance or mechanics' or other liens nnder the covenants in said trust deed contained, with interest thereon at ths rate of one per cent (1 per cent) .per month from the date ef the payment thereof. Third Pay the amount remaining unpaid un-paid on said above-described note for prineipal and interest, calculating interest np to the day ef sale.
