| Show SENSATIONAL DIVORCE The Old Case of Fred King vs Jennie Jen-nie ICing Renewed The hearing of the divorce suit of Fred King vs Jennie f King was begun In Judge Bartchs court yester day afternoon The original complaint was filed on February 19 1892 and set out that the parties were married at Oakland Me several years before the commencement of the suit Then the complaint al leges that for several months last past at Salt Lake city the defendant Mrs King committed adultery at various times with one W P Evans and that on Sunday night February 1 1892 in a sleeping car en route from Salt Lake to Denver Colo she committed adul tery with Evans and has ever since been living in adulterous intercourse with him On February 25 1892 the plaintiff made an affidavit that he was unable to find the defendant she having departed de-parted from the territory and on this summons was allowed to be served by publication On May 21 1892 the case came on for hearing and a decree of divorce was ± granted the plaintiff by default un uarcn 21 1893 came the defendant defend-ant 1s King and prayed that the I decree be set aside alleging that I was obtained by fraud that she dId not know of the pending of the suIt I and that the allegations of adultery were false The decree was set aIde and Mrs King entered an answer and I crosscomplaint the former denyIng i all the allegations of the complaInt I and ithe latter praying for a dIvorce and alimony and an equal division of the property amounting to 15000 Messrs Day Street appeared for the plaintiff and Mrs King was rep I resented by Messrs Powers Straup Lippman and Attorney Lochrie I Evidence For the Plaintiff C A Creamer passenger conductor on ithe R G W railway between Ogden Og-den and Grand Junction was such in February 1892 Mrs King got on de fendants train at Salt Lake She after af-ter the train had left Salt Lake inquired in-quired If a berth had been reserved for a gentleman who would get on the train at Springville The gentleman one W P Evans got on at Spring vie Mrs King and Evans went to the sleeper together Evans called Mrs King his wife which astonished witness very much a he was acquainted ac-quainted with Mr King the huSband of ithe defendant Witness left the train at 930 at Grand Junction and the parties went on to Denver Dan Creamer son of the previous I witness was brakeman on the same train on which his father was conductor con-ductor The evidence of ithis witness was practically the same a < that of C A Creamer Conductor Goes After Evans William f Newman passenger conductor con-ductor on the R G W from Grand Junction to Salida testified that he saw Ir King on his train on he morning of February 15 1892 He saw the Pullman conductor get after W P Evans and get him out of a lower berth which he was occupying with a lady Witness didnt at that time seethe see-the lady but afterwards saw Evans and Mrs King together Evans and the conductor had an altercation al 1 hlh l 11M i i Evans appeared to be trying ito make an arrangement for the conductor to say nothing about him being with the lady lad1lat AVliat the Pullman Conductor Saw J L Doutremont was Pullman conductor con-ductor on the R G W from Ogden to Denver remembered February 1 1892 W P Evans and Mrs King traveled in the sleeper that night Evanss berth was lower 5 and Mrs Kings lower 10 During the night witness found them both occupying berth lower 10 He made Evans get out and go to his own berth Evans wanted to fix the matter so that nothing would be said about i and Mrs King the next day also asked witness to say nothing about I as if he did it would create an awful fuss Several other witness were examined for the plaintiff and at 5 oclock a continuance was taken until 2 p m today Grateful comforting food is that supplied sup-plied to weary millions by the aid of Dr Prices baking powder a household word for 40 years |
