Show DELAW ARES S DEADLOCK Result is i Regarded With Great Interest at the Capital A SOME UNIQUE ASPECTS Outcome of the Coming Contest In Doubt io Doubt but That Governor Watson Wat-son Will Appoint n Senator on the Theory That the Legislature Adjourned Without Electing One and In 1 Probability the Contest Will be CloseSome Precedents Washington May 10The condition In which the Delaware senatorship was left by the adjournment of the legislature of that state is regarded with special interest inter-est in senatorial circles I is believed that the case will present some aspects that are unique in the history his-tory of the Senate I is held by some persons that the outcome out-come of the contest may prevent the organization or-ganization of the Senate by the Republicans Republi-cans at the beginning of the next session The Democrats may find It to their interest inter-est t continue in control of the committees commit-tees as long as possible The Delaware question would bo referred to the committee com-mittee on privileges and elections of which Senator Gray of Delaware is now chairman In case of a purely partisan contest the control of the committee might b of no little importance to the Democrats Senator Morgan of Alabama in discussing dis-cussing the question said I The action of the governor in the premise will be of importance In determining deter-mining the course of the Senate when the I question of seating Mr Dupont will come up for consideration The law requires a certificate of election from the governor and while I do not feel that I know sufficient I suffi-cient o the facts in this case to express I i a positive opinion I should sale that the I presumption would be against a man who i I would apply to be seated without presentIng I I present-ing such evidence of the validity of his I I claims I know of but one instance in which the Senate has seated a man in the of election from absence a certificate of electon frm the governor and that was Jit the case of Senator Conkhng whose certificate failed to arrive on one occasion in time for the organization of the Senate In that case however Mr Conklings election was unuisputed and there was a telegram sayingthat the certificate was on the way Ito I-to Washington cerifcte The only way In which the Delaware Democrats can legitimately secure a hearing in the Senate is for Governor Watson to appoint a senator on the theo appint ry that the legislature ha adjourned without l tng and this I presume he i will do In that event in all probability I there would be a close contest I have differed from many of my Democratic colt col-t leagues In holding that under such circumstances I cir-cumstances the governor of a state had aright a-right to appoint and that when he did I appoint it was the duty of the Senate to seat the appointee This was the question I ques-tion involved at the beginning of the Fif I tythird Congress in the case of appointments I ap-pointments from Washington Montana t and Wyoming and I then took a position I in favor of seating these men You will remember however that the verdict of I the Senate was against them |
