Suing Street Car Company Winslow Fart and wife yesterday sought remuneration for damage4 to their property on Sixteenth street 5y reaen of the construction of the street railway up that throughfaro They tiled a suit for 2000 damages The action ac-tion is brought against the Ogden City Street Railway compafl9 instead of against the Ogden Railway company which is the name tlte organization lost incorporated under and which it is npw doing business under The complaint recites tire damage to adjacent property proper-ty by reason of the construction of the line and further specifies that the cool pany is not obeying the city ordinance In regard to the care of its tracks The particular ground for the suib is that the track was laid near the south side of the street instead of in the middle thus discriminating ag1inst property owners on the south side The Seventeenth street track is laid in a similar manner It is claimed this I due to instructions from the street cam mittee and hence the cIty may be brought into the suit
