| Show fflLLMTOFS CASE After an Exciting Trial He i Acquitted H STORY OF HIS AFFECTION For Mrs Avery and the Stranjre and Sudden Death of Her Husband Killed in an Opera House DENVER Colo April 29Specinl telegram tele-gram to THE HERALD IThe Millington case was submitted to the jury at 830 this afternoon This is a case brought down from Fort Collins in Larimie county Frank Millington and Mrs William I Avery fell in love with each other and their actions soon brought the fact to the I knowledge of a large circle In June last Mr Avery died and was buried The physicians said the cause of death was gastric fever The talk and scandal connecting con-necting the parties became louder after the husbands death and the body was exhumed ex-humed and examined The first autopsy failed to find poison but showed that the stomach had been greatly irritated A second examination was made and arsnic found In the meantime and within two weeks after Averys death Millincton and Mrs Avery wera married in Nebraska and an attempt was made to keep the wedding wed-ding quiet This led the people of For 1 Collins to demand 0 further investigation and Mr and Mrs Millington and Diflie Millington a sister of the new husband were arrested charged with causinp Averys death by poison The case was t brought to Denver on a change of venue and commenced on January 27 Senator Ballard Judge Belford and Luther L Mills of Chicago were counsel for the prosecution and Hon C S Thomas and Hon T M Patterson for the defense The case has been the most bitterly fought ever before the courts of Denver the 4 high standing of the attorneys in the case S being sustained by their fighting every point Over a hundred witnesses wen examined for the prosecution and about thirty for the defense Today a sensation sensa-tion was stirred up just previous to the submission to the jury by Mr Patterson charging one of the jury had been bribed and offering to produce affidavits to that effect The judge would not take acton on the charge at that stage of the case At about oclock tonight the jury brought in a verdict of not guilty and the defendants defend-ants were discharged The verdict was t greeted with cheers by the crowd assembled assem-bled as at no time was the evidence strong enough for conviction Thus ends a case that has excited more ieelmg in Denver than any other ever tried here |
