Show MAInEd NEW PROHIBITORY LAW For many years Maine has had a prohibitory pro-hibitory law which has been enforced with all the vigor and determination of which earnest andcapable officials backed by a bealty public sentiment could command and yet liquor has been sold freely in all cities cit-ies of the state during all of these years and the police court records testify to the fact that drunkenness is as common in Maine as elsewhere The good people are not discouraged dis-couraged however and they persist in their warfare againstthe evil of intemperance intemper-ance with a degree of enthusiasm and hopefulness hope-fulness which is nothing less than admirable admira-ble The late legislature in compliance compli-ance with a popular demand passed some radical amendments to the law and these went into effect yesterday The penalties for violating tee statute have been increased and new methods provided for pursuing the offenders According to an exchange any person may institute proceedings against tile bondsmen of an innkeeper or victualer for violation of the law regarding regard-ing the selling of intoxicating liquors a bona for 5100 being required before he can take out a license A fine of 500 and imprisonment im-prisonment for one year and in default of fine an additional years imprisonment is the penalty for illegal transportation of liquors Express railroad and steamboat companies may be fined 500 for illegal transportation and knowledge on the part of an authorized agent is knowledge on the part of the corporation The penalty for conviction under search and seizure process pro-cess is 8100 and costs and sixty days in jail for first offense and in default of payment of fine and costs an additional sixty days in jail is imposed A search of person for liquors can be made at the time search of I place Is made without the formality of arrest ar-rest and if liquors are found the person per-son may be arrested and held for keeping them intended for unlawful sale Any person suspected of keeping intoxicating liquors in his pockets for sale may be searched by the same process as is provided for tho search of places and if liquors are found upon his person he may be held the same as if found upon his premises The pouring out of any fluids or the destroying of them by a tenant assistant or other person when the premises prem-ises aro about to bo searched for the pur pose of preventing their seizure by officers is sufficient to have them held as intoxicating intoxicat-ing and intended for unlawful sale and the penalty is the same as if they had been seized The penalty for drunkenness has been increased to a fine of 10 and costs or imprisonment im-prisonment for thirty days for the first offense and tho matter of imposing the penalty is not discretionary with the judge the offense being proven For every subsequent sub-sequent drunk the punishment is to be imprisonment im-prisonment for thirty days And still wo shall expect to hear of tho common sale of intoxicants in Maine of drunkenness and of the demand of the temperance people for more stringent legislation legis-lation |
