Choate and the rather sensational testimony elicited from R B Dey formerly private secrelary to Mr Mackay Mackay denied that he ever agreed to pay Stokes anything excepting for his services and swore that the 25000 was involved in another transaction A letter l from Mackay admitting Stokes interest in-terest in the United Lines Telegraph company com-pany was read by Mr Choate The witness wit-ness admitted that Stokes represented him r when the loiter was written and then contradicted con-tradicted himself by saying tlat Stokes had no interest in toe telegraph lines Were you born in Ireland agreement made by Stokes Then Mr Choato showed the wit ness a letter for the purpose of having nim identify his own handwriting in which he referred to Gould and his gang A number ot other letters from Mackay were read in one of which bo advised Stokes to sell out his Stokes bonds and another in which he said he would rather lose 100000 than see Stokes get stuck The Postal Telegraph company witness said was making from 300000 to 400JOO a vear but it was not a valuable feeder for duced tho cable company Mr Choate then pro MR MACKATS SWORN STATE I Tin T-in another suit in which sui he stated it was a valuable feeder for the cable company R B Dey was then called and testified that after his arrival here in testifed tS he found Stokes account with Mr MacUay was 6700000 short and that Stokes told him he could not account for the money because his bookkeeper Smith had gone away After further investigation this amount was reduced to 450000 Stores was unable to account for this sum and he has never accounted for it In July 1SS9 witness called Stokes attention t tho fact that been half a million of Mr Mackays money had I I SIENT ON THE HOFFMAN HOUSE for which be had never made an account ug to Mr Maekuy although Stokes had In the meantime increased his bank account J500000 When he asked Stokes why ho had not paid Stokes something Stokes told him his money was all gone he did not know where Witness was then crossexamined by Mr Untermeyer of counsel for Stokes Dey suid be had been Mackays private secretary from 1S84 until last October He was a witLess in the case at tho request of Mr Mackay What other occupation did you have during the time you were in the employ of Mr Mackay I had a share of Mrs Senator Fairs business Wero you not employed by Senator Fair to get information against himself informaton himsel on L which Mrs Fair could procure a divorce from him in May 1SS32 Yes Did you not bring suit against Fair for 550000 lor such services I did Did you not Mr 11 meyer brought out the fiict that the witness wit-ness in figuring up 700000 shortage charged Stokes with moneys pnid over by Platt to Decastro and tnat he had charger all the checks whicII Decastro had given to Stokes to the latter I WITHOUT GIVING STOKES CREDIT for checks ho had paid Ho had also charged Stores with moneys paid to C C Brown Co C H Read Co and others He had only an incomplete account from Decastro and had not made up any account of any kind since tho checks were all turned in Stokes was then called in rebuttal and denied Deys testimony in almost every particular Mr tLaroque then then took Mr Stokes in band When did you give Mr Untermeyer the points upon which he attached Mr Deys character Today in court Mr Laroque then said something about the inconsistency
