Show First District Court Judge James A Miner on the bench Oregon Short Line Utah Northern railway company vs J A Bacon trustee motion of W VanCott order granting plaintiff to and including March 30 1891 to serve and file statement on motion for anew a-new trial Melissa Smith vs S M Scott et al order striking out answer plaintiff to take judgment W C Parker et al vs C R Hank el al on motion of H H Rolapp order granting permission to open and file depositions W CParker et al vs C R Hank et al trial Richards Rolapp and Barton for plaintiff Kimball Allison and Smith Smith for defendant The above case is in relation to the sale of a tract of land W C Parker and three sons reside just outside the city limits Some time ago Mr Hank negotiated with them for one hundred acres of their property prop-erty The proposition made between them is said to have been as follows Mr Hank was in the real estate business and was secured by Parker and sons to find a buyer for the property in question for at least 50 per acre or more if he could get it and he Hank was to receive 5 per cent of the amount received for the property for making mak-ing the sale Hank sold the property to a Denver syndicate for 100 per acre and succeeded in getting the property deeded to him at that figure reserving the 5 percent per-cent commission on the deal He then deeded the property to the Denver people and made a clean profit of about 5000 Parker Par-ker Son brought suit to recover the5000 The case was submitted to the jury at 4 p m with orders to return a sealed verdict ver-dict which will probably be announced this forenoon Hyrum A Smith vs John P Smith et aL jon j-on motion dismissed at plaintiffs cost The People etc vs Frank Duffy Frank Stover and J Brown bonds forfeited defendants de-fendants did not come in and plead as ordered or-dered A H Nelson vs John Harris trial pending |
