Show Trial date set for Cedar Hills Annex dispute Judge J. Robert Bullock of the Fourth District Court in Provo has set June 11 for trial of the five-year-old dispute between property owners of land annexed in 1979 by the city of Cedar Hills. Cedar Hills had filed a motion to dismiss the suit claiming the property owners did not have a standing for such action and only municipalities could be involved. Last Friday, Judge Bullock ruled the property owners did have standing and ordered the case to trial. The dispute began in 1979 after Cedar Hills attempted to annex property from its south boundary to 8800 North. At that same time Pleasant Grove had attempted to annex a portion of the same area . With this action the annexation problem was thrown into the laps of the Utah County Boundary Commission Com-mission who ruled that 266 acres which belonged to 50 property i owners could be annexed by Cedar Hills. Pleasant Grove was allowed to annex to the south side of 8800 North. However property owners inside the Cedar Hills annexation protested that action in the Fourth District Court. Judge Bullock issued a summary judgment in favor of the property owners, after which Cedar Hills appealed the ruling to the Utah Supreme Court. This court ruled that the case should be tried again in district court. |
