Legal No. 1984-- 6 Research, development park ordinance is outlined I AN ORDINANCE CREATING WITHIN THE CITY LIMITS OF PLEASANT GROVE CITY A RESEARCH & DEVELOPMENT PA-RK DISTRICT TO BE KNOWN AS RESEARCH & DEVELOPMENT PA-RK DISTRICT (R&D PARK) WHICH SHALL COVER AND APPLY TO ANY AREA WITHIN THE PLEASANT GROVE CITY LIMITS NOW AND HEREAFTER SO DESIGNATED PUR-SUANT TO OFFICIAL RECLASSIFICATION OF ANY ZONING DISTRICT PROPER-TY. Be it ordained by the City Council of Pleasant Grove City, Utah County, State of Utah, as follows : SECTION 1: For the purpose of this Or-dinance, certain words and phrases shall be defined as follows: ( a ) Accessory buildings and uses: Subordinate secondary structures and uses necessary for the conduct of the primary approved use will be considered when clearly incidental. For example garages and carports, refuse en-- j closures and other incidental storage , facilities, and security , sidered in the group of the general citizenry. Also considered, will be relief from the monotonous somewhat uniform subdividing of the countryside. It will be considered a positive factor if the develop-ment provides an aesthetic relief. (d) Integrated development plan: Comprehensive man-agement for best assurance of main-taining standards and conditions of approval is the intent in the administration of the conditional use permit. Therefore, every assurance will be required to minimize the problems of en-forcement through approved management plans which have been negotiated in mutual interest, prepared by the applicant and ap-proved by the City. Single responsible management is felt crucial to consistent care and observance of binding regulations in assuring compatibility with the surrounding area. Agreed upon penalties for violations af the management plan are considered an important integral part af the conditional use veillance: When security is a paramount concern for a development, it may require continuous and complete surveillance to the degree that there are no public streets and access is through a guarded gate. Under these circumstances it is in the interests of the City to vary requirements sufficient to permit total control by a manager who can be held responsible for maintaining the standards of the con-ditional use permit. (h) Temporary uses: Construction facilities, emergency facilities, and such other tem-porary uses will be considered as well as those interim uses of land and buildings awaiting ultimate use, i.e. pasture for a few months before con-struction can begin, or a carnival, fair, sports field, etc. SECTION 2. District Created: There is hereby created within the City limits of Pleasant Grove City, a research and development park district to be known as Research & Develop-ment Park District (R&D Park), which shall cover and sddIv to district except as provided in this Code. A. Permitted Uses: None. B. Conditional Uses: 1. Professional, scientific, research and development offices and attendant g light manufacturing proces-sing and testing facilities for current and horizon state of the art technology items and electronics. 2. Other comparable and related (or similar) activities as may be determined by the Planning Commission and approved by the City Council. 3. Accessory buildings and uses customarily incidental to the above conditional uses. 4. Temporary uses found appropriate by the Planning Com-mission and approved by the City Council. 5. Public facilities and public service facilities. SECTION 5. Area Regulations: The minimum area for any Research and Development Park District shall be nine acres. The minimum lot size within any Research and Development Park District shall hp thrpp the principal use of the set back shall be for landscaping and other beautifications. B. All buildings and above ground struc-tures shall set back from side property lines at least 15 feet and be separated from other buildings at least 30 feet to provide for and beautification. C. All buildings and above ground struc-tures shall set back from rear property lines at least 30 feet. D. All loading and unloading shall be located behind the front set back line and be so designed as to promote convenience and aesthetics. E. parking shall be located within the buildable area except it may extend to 15 feet from the front property line bordering on a public street or district boundary adjoining residential develop-ment, or to 5 feet from a real property line which is not a district bou-ndary, when the remaining set back area is landscaped with trees, shrubs and berms which produce an aesthetic screen and transition. Property values must be sustained or enhanced as opposed to diminishing values; the effects of ultimate traffic on streets will be considered rather than complaints that a new development will in-crease unwanted traffic ; improvements in the infrastructure will be considered as to how and who pays for them; positive co-ntributions to the financing of needed improvements will be weighed against the assessment on existing residential develop-ments; proximity of possible impacts will be evaluated and non-direct-impacted citizens will be con- - ji mil.. (e) Light manufac-turing: Only those prpc.gsseswhich clearly do not "Jhreaten the environment "tyith any more pollution than that normally experienced in the neighborhood will be considered com-patible with the area. Therefore, light manufacturing includes-suc-h uses as elec-tronics, non-toxi- c weldingsoldering of small items, assem-blage of relatively small portable devices, highly controlled testing, and small area warehousestorage fa-cilities to accomodate the manufactured items with their associated stocks of supplies. (f) Public Facilities and public service facilities: For the public convenience, infrastructure including streets, water lines, sewer lines, public utilties and drainage facilities etc. are to be allowed to serve the area and vicinity. Possible additional facilities such as sub-stations for fire or police, or even a post office, etc. may be desirable as well. (g) Security sur- - any area within the Pleasant Grove City limits now and hereafter so designated pursuant to official reclassification of any zoning - district property. SECTION 3. Purpose: The Research & Development Park District is created to provide areas in ap-propriate locations for parklike well land-scaped low intensity development com-patible with residential surroundings where certain research and development activities may blend with other aesthetic and desirable developments. This district is provided for those desirable highly aesthetic developments which improve the value of surroundings areas and do not create unusual infrastructure problems. SECTION 4. Use Regulations: No building, structure or land shall be used and no building or structure shall be hereafter erected, structurally altered, enlarged or maintained in a research and development park acres for an in-dependent development that is not part of a total integrated and ad-ministered develop-ment plan containing at - least nine acres. SECTION 6. Width and Frontage Regulations: A. The minimum width and frontage on a public street shall be 400 feet for any Research and Development Park District or integrated project development. B. The minimum width and frontage on a public street shall be 100 feet for any lot, whether or not it is in an integrated project development, except when the lot is part of a comprehensive in-tegrated project which is designed and maintained under security surveillance which precludes direct access to the lot from a public street. SECTION 7. Setback Regulations: A. All buildings and above ground struc-tures shall set back from public streets and district boundaries a minimum of 35 feet, and F- - A landscaped area a minimum of 15 feet wide shall be provided along the entire perimeter of a Research '"" and Development Park District, except for crossing streets, to serve as an effective screen and transition for adjoining developments. SECTION 8. Height Regulations: The maximum height of all buildings and struc-tures shall be 35 feet, except for antenna, flga poles and other ap-purtenances as may be approved by the Planning Commission. SECTION 9. Coverage Regulations: The maximum coverage of any lot by buildings and struc-tures shall be 30 and by all impervious surfaces 75. SECTION 10.
