Show Calendar Suit To Ski Team j J.-The United States Ski Team I has, once again, emerged I Victorious. But, this time it 'was in court. j r The suit was against Kest j Enterprises, a company in j California which, in previous "years, printed the U.S. Ski Team Calendar. In June, 1982, however, the ski team and Kest parted company when their contract ran out. But Kest saw it differently than the ski team did. They went ahead and printed a 1983 calendar, entitled "1983 U.S. Skiing Calendar" and distributed it. The cover of the calendar had a picture of Steve Mahre in a ski meet in which the team participated. partici-pated. It was inaccurately labelled Phil Mahre. When Kest refused to take the calendar off the market, the team, represented- by Attorneys Gordon Strachan and Jeff Oritt of Salt Lake City, sued. They obtained a temporary restraining order which directed Kest to withdraw the calendar from sale. When the case came up for hearing on November 16, 1982, Federal Court Judge Aldon Anderson ruled in favor of the ski team even though Kest said they had rights to the photo from ski manufacturers. The judge granted an injunction which denies Kest the right to distribute the calendar nationwide. na-tionwide. And what happened to all the calendars? Well, if Kest wants to distribute them, they'll have to do it'through the ski team. And since they were ordered to pay all attorneys fees, they may have to. |
