Counsel for H I Charles S Mellen, presideut of the j Ne Haves railroad, filed a plea of abatement In the United States dls- trlct court today, asserting that the recent indictments agalns Mellen. .President E J. Chaniberlin. Of the Grand Trunk railway, and Alfred Smitbers, chairman of the Grand Trunk were void because one of the erand 'jurors. Alfred A. Stephens, was a resident of New Jersey. Messrs. Mellen. Chaniberlin and i ! Smlthers were indicted on charges of violation of the criminal clause 'of the Sherman anti-trust law for participation In an alleged monopoly agreement between the two railroads. |
