house on the adoption of the resolution of the majority of abo committee to scat martin again mr bailey vigorously protested he demanded the yeas and nays on the question of re committing the case to nays while this vote was in progress the democratic members vacated their seats for the purpose of breaking a quorum leaving mr bailey in charge of the case for the minority and two or three associates on guard the question was then put on the resolution declaring martin entitled to the seat and the vote was ayes nays 5 no quorum blandly beugge ted mr bailey the chair overrules tee point
