James Martin against the Davis County Light and Power company, the Home Telephone company com-pany and Thomas Phlllipps, receler. et al, filed in the distr.ct court Wednesday Wed-nesday evening, another dissatisfied stockholder makes a protest ' Mr. Martin alleges that the Cotterell Brothers, acting as stock brokers solicited solic-ited the purchase of stock of the defendant de-fendant Light and Power company of twenty-eight different persons, besides be-sides himself, and succeeded In getting get-ting them to buy. It was represented that the company In question had a power plant by wh.'ch they could furnish fur-nish light and power and that the plant was an extensive cne and in condition to do the work required In the lighting of many homes. The plaintiff alleges, however, that the company has no electric light plant and that It cannot furnish light and power as represented by Its solicitors solic-itors Twenty-e'ght accounts have been assigned to Mr. Martin which, with his own, aggregates $3,141 70 He asks for judgment In this amount, together to-gether with $150 attorney fees, costs of court and interest on the money from December 27, 1910. |
