Utah, 'that: I Section 1. No person by him- 1 self, his clerk, servant, employ- I ee or agent, shall, for himself or I any person else, directly or indi- 1 ' rectly, or upon any pretense, or '- 1 with any devise, except as pro- : 1 vided in this act, manufacture, i I sell, exchange, barter, dispense, ' 1 ' serve, give in consideration of 1 the purchase of any property, or I of any services, or in the evasion I f of this act, or keep for sale, any I ' intoxicating liquors, or solicit, I. take or accept any order for the i purchase, sale, shipment, ser- 1 vice or delivery of any such, li- quor, or aid in the delivery and I ' distribution of any intoxicating 1 liquor so ordered or shipped, or 1 ' own, keep or be in any way con- . - cerned, engaged or employed in 1 the owning or keeping any in- 1 ., toxicating liquor with intent to 1 - . violate any of the provisions of I . this act, or authorize the same I -".. to be done. I Section 2. Sale upon Prescrip- ' 1 tion. Any registered pharmacist &iiiiiiiMmay'wlthinthe city, of Cedaras dW-- hereinafter provided, sell and 1 furnish intoxicating liquors for I medicinal purposes only, upon '"-" , the written prescription pf a reg- 1 ularly practicing physician of I this State, in the manner here- I " inafter provided. The prescrip- I tion shall contain the full name I of the person prescribed for, the 1 quantity and kind of liquor pre- scribed, the da e upon which the I prescription is issued, and shall I be signed by the prescribing physician. No prescription sn"all 1 be filled hereupon except upon the day upon which it is dated and 1 issued, or upon the following I day. 1 On the first day of June and J January of each year, the regis- tered pharmacist shall file all I said prescriptions filled within 1 the proceeding six months, with the city Recorder of said Cedar i City, and a certified copy of the I same or the original prescription I shall at any time after having 1 been filled be open to public in- 1 spection. A fee of one dollar I for each such lot of prescriptions 1 so filed shall be paid by such 1 druggist or registred pharmacist 1 to the City Recorder. No pre- 1 scription shall be refilled, nor I shall more than one quart be I furnished on one prescription. 1 Nothing in this act shall be con- K strued to prevent druggists or H registered pharmacists furnish- jE ing or selling intoxicating liquors in wholesale quantities to reg- I istered pharmacists, to public or W charitable hospitals, to medical B or pharmaceutical colleges or ,to 9 scientific schools or institutions. H All druggists or registered phar- H macists shall keep a complete m. record of all sales at wholesale H of intoxicating liquor which rec- H ord shall be open to the inspec- H tion of the peace officer of the I City. No physician shall issue H a prescription except for a bona jPj fide medical purpose. 'Section 3. PATENT MEDICINES. MEDI-CINES. No person or corporation corpora-tion within this City, shall sell, dispose of or give away any proprietary, patent or compound medicines classed 'by the Commissioners Com-missioners of Internal Revenue as subject to the U. S. Internal Special Tax as an intoxicating liquor insufficienlty medicated to render them unsalable as beverages, bever-ages, except upon the prescription prescrip-tion of a licensed and practicing physician of this State. Section 4. SALE OF ALCOHOL ALCO-HOL AND WINES FOR SPECIAL SPEC-IAL PURPOSES PERMITTED. Nothing in this act shall prohibit prohib-it the sale by licensed pharmacists pharma-cists or wholesale druggists within this City, of alcohol for art, scientific or mechanical pur-purposes, pur-purposes, or wines to Churches for sacramental purposes. A record of each sale shall be made and preserved in a book kept for that purpose, signed by the per son receiving the same, which record shall be open to public inspection. in-spection. No person shall purchase pur-chase any such alcohol or wine for any use other than stated in this section. Section 5. All places where intoxicating liquors are manu- . factured, sold, given away or otherwise furnished in violation of law or where persons are permitted per-mitted to resort for the purpose of drinking intoxicating liquor as a beverage in violation of law or where intoxicating liquors are kept for sale, given away or otherwise oth-erwise furnishing in violation of law, and all intoxicating liquors, bottles, glasses, kegs, pumps, bars and other property kept in and used in maintaining such a place are hereby declared to be common nuisances; and every person who maintains or assists maintaining suchui placeshall be "guilty of a misdemeanor. Section G. PENALTY. Any person or corporation who in any way violates any of the provisions provis-ions of this act shall be guilty of a misdemeanor and upon conviction convic-tion thereof shall be punished by a fine of not less than fifty dollars dol-lars nor more than two hundred and ninety nine dollars or by imprisonment im-prisonment in the City jail for not less than thirty days nor more than six months, or by both such fine and imprisonment. imprison-ment. Section 8. This ordinance shall take effect, and be in force from and after the 17th day of June, A. D., 1912. Passed by the City Council of Cedar City, Utah, this 10th day of June, A. D 1912.
