Show Sixth District Court Actions PANGUITCH Judge K.L. Mclff presided over a fairly light court schedule in Sixth Judicial District Court on Thursday, Dec. 20. Terry Arnold Messer, 28, and David Hoschouer, 33, inmates at the Garfield County Correctional Facility were before the court for scheduling of their cases on first and second degree felony charges of possession posses-sion of a controlled substance in a correctional facility. Counsel for Messer was D. Bruce Oliver and Keith Barnes was reappointed for Hoschouer. Their cases were set for jury trial on April 8-9, 2002. Gregory Ficht, 41, Phoenix, Ariz, was before the court on a second degree felony count of theft by deception. Ficht was represented by Keith Barnes. A plea agreement was reached whereby Ficht pleaded guilty to a single second degree felony count. All other charges including includ-ing joyriding and two counts of contracting without a license were dismissed. Ficht will be extradited to Michigan on additional addi-tional charges. Clayton Burningham, 32, Panguitch, was before the court on a status review of a charge of criminal non-support, a third degree felony. He was represented repre-sented by Keith Barnes. A jury trial was set for Apr. 1 , 2002. Tonya Franc Szakacs, 29, of Mt. Pleasant appeared in court on a order to show cause why probation should . not be revoked. She had been charged with illegal possession of a controlled con-trolled substance, a third degree felony. She admitted in court to five points 1) having failed to pay supervisory fees, 2) failed to complete 40 hours of community communi-ty service, 3) having used, possessed pos-sessed marijuana, 4) having used, possessed methampheta-mine methampheta-mine and 5) failed to obtain a mental health evaluation. Judge Mclff found her in violation of probation agreement, ordered that she meet with Adult Probation and Parole and that she also obtain a mental health evaluation within four weeks. Her case will be reviewed on Jan. 17. Mark D. Talbot, 39, Panguitch, was before the court on a preliminary hearing for three counts, a first degree felony of possession with intent to distribute; a class A misdemeanor misde-meanor for use or possession of drug paraphernalia and class A misdemeanor of possession with intent to manufacture or produce. pro-duce. He was represented by ' Attorney Marcus Taylor of Richfield. Talbot . was bound over of all charges with a status review of this case set for Jan. 17. (See COURT on page 3-A) i COURT From Front Page Talbot also made an initial appearance on five charges relating to an incident Nov. 4 with the Sevier County Drug Task Force. He was charged additionally with 1) possession of. a controlled substance (methamphetamine), a first degree felony with a prior conviction, con-viction, 2) possession of a controlled con-trolled substance (methamphetamine) (methamphet-amine) in urine with a prior conviction, a second degree felony, 3) poss. of a controlled substance (cocaine) with a prior conviction, a second degree felony, 4) possession of a controlled con-trolled substance (marijuana), a class A misdemeanor, and 5) possession of drug paraphernalia in a drug free zone, a class A misdemeanor. Talbot was booked into the county jail and bail was set at $25,000 cash or $50,000 property. This case was set for a preliminary hearing on Jan. 17. |
