Show District Court Cases Heard in Panguitch Action taken in Sixth Judicial District Court before Judge Don V. Tibbs, Feb. 3. Roy Howard Wheeler, 23, Arizona desired to sign a waiver of extradition and be returned to the State of Arizona to answer to a warrant of arrest. The waiver was granted, signed and witnessed. JakePoteet, Escalante, scheduled to appear on several motions before the court, refused to attend even after promptings from his attorney in the presence of the Garfield County Sheriff. Motions were all continued to be heard as soon as possible prior to the scheduled trial date of Feb. 28. In the case of Roy O. and Norma J. Chlarson vs. Charles Wintch, et al, the matter was before the court on a stipulation and order. Both parties had agreed to a settlement. After the court reviewed both sides the stipulation was granted. In the case of Canyon Homestead, Inc. vs Marlin J. Stewart and Candice Stewart. It was found that defendants failed to have counsel appointed and to appear before the court. The motion for summary judgement was granted. Paul Butler, Panguitch, was denied a motion for a new trial following review of the trial proceedings. In the matter of Clement Johnson and Derrell Johnson vs Avon Payton, on a motion for partial judgment, the case was continued to be heard March 3, 1983 at 11 a.m. The matter of Burns O. Ormond and Blom H. Ormond vs Mark G. Nelson and Kim Nelson, et al which was before the court on a motion for summary judgement. Following discussion this case was merged with civil case no. 2991 and set for a pre-trial hearing on March 3, 1983 at 11 a.m. In the matter of Gaud Hawk Corporation vs Vaughn Heaton and Vaughn Heaton dba as H&R Hardware, the case was set for trial on March 31, 1983. The matter of Zions First National Bank vs Kenneth L. McLemore was set for trial on March 3, 1983. In the matter of Regina L. Hall vs Frankie Wayne Hall, a continuance was granted until March 3, 1983. In the matter of Clarence A. Davis vs Claudia E. Davis, a default divorce request, the matter was granted. In the matter of Peggy Sue Lewis vs Robert Stephen Lewis for a default divorce, a Kane County case being heard in Garfield County, the request was granted. In the matter of Pattl Renee Songster vs Robert Joseph Songster on a motion to dismiss, the motion was granted. In the matter of a petition for name change request by George Lee Hecke and Martin Webb Hecke, the petition was granted for a name change to Smith. In the matter of Elijah D. Moore vs Lucy Velarde Moore in a request for a non-jury trial, the trial was set for March 3, 1983. In the matter of Donna C. Bailey vs Delia Christiansen, et al before the court on a petition for a rehearing of intervener's motion to intervene and motion of or relief from judgement on order. After hearing arguments from both sides the court granted the motion to intervene. Matter was set for trial in April 1983. |
