Owing to tho fact that a question was raised as to tho legality of tho board of pardons noting on now matters mat-ters at n special session, Frank Wy-mnn, Wy-mnn, attorney for Orchard, filed with tho govornor n petition for a roprlovo, ro-prlovo, nnd tho board, which had been called to moot Wednesday night, was advised that tho session would not bo hold. Govornor Gooding promptly assurod Mr. Wyman that ho would not pormlt Orchard to bo hanged without a hearing of his caso by tho board, and tho order for a stay ot 6ontonco followed.
