The present arrangement does not, however, provide a basis for people residing outside these taxing districts and outside Huntsville Town, such as East Huntsville and Ogden Canyon, to share in the expenses of operating the parks, other than by voluntary contributions. Huntsville Park is used heavily, and has many improvements underway, all of which create the need for funding beyond that provided by taxing the residents of Huntsville Town. Some possible solutions discussed at the meeting were: Form a new park-taxing district. This would have to be initiated by the residents outside of Huntsville Town and, at this point, there doesn’t seem to be a great deal of interest in doing so. Also, taxing districts are created specifically for the creation of new parks, such as the creation of a park in East Huntsville. Charge for park use. Hire someone to run a concession stand. After discussion, the group agreed that many people who use and enjoy the park don’t mind paying their “fair share,” but lack knowledge of how to go about doing so. The group agreed that continued, but more widespread, voluntary contributions to the park’s maintenance and improvements provides the most efficient and desirable method to meet the park’s needs. Making voluntary contributions to the park gives people a feeling of pride and ownership to “their park,” and fosters a spirit of community and neighborliness. Only $75,000 Protect Yourself From Having to Pay Your Construction Bills Twice Compiled by Shanna Francis Ogden Valley News The scenario isn’t all that uncommon. You hire a contractor to build a home, add on to your home, do some major remodeling, or have some major landscaping completed. As a responsible party you, the homeowner, pay the final bill in a timely manner after the work is completed. But the next thing you know, you receive a notice in the mail that you are being sued for nonpayment by a subcontractor who was never paid by your contractor. Unfortunately, it is not uncommon for a homeowner to pay for construction on his or her residence, and then have to pay the bill a second time in order to satisfy liens on the same residence filed by unpaid contractors, laborers, and/or suppliers. Fortunately, there is now a better balance between the rights of the homeowner and the rights of those who file claims for non-payment under the Mechanics’ Lien law. In 1994, the Residence Lien Restriction and Lien Recovery Fund Act established a means for the protection of homeowners, while creating a fund to provide payment for unpaid subcontractors, suppliers, and laborer materials, and labor provided on single-family or duplex residences. It is important to remember that this Act does not prohibit the filing of a mechanics’ lien. However, it does prohibit the maintenance of the lien and the recovery of payment from the homeowner once the homeowner as proven compliance with the Act’s requirements, thereby warranting protection under the Act. If unable to obtain payment through the mechanics’ lien process due to the homeowner’s protection under the Act, laborers, suppliers, and subcontractors may then seek payment from the Fund for unpaid labor and/or materials. This protection applies to new home construction as well as remodel or repair on an existing home. The Act requires the homeowner to bear some responsibility for protecting the residence under construction. Before signing with any contractor, the homeowner should contact the Utah Division of Occupational and Professional Licensing (DOPL) to verify that the contractor holds a valid contractor’s license in the state of Utah under the classifi- cation for which the work is to be done. Additionally, to gain protection from a mechanics’ lien, the homeowner must comply with the specific requirements of the Act. Section 38-11-107 of the Utah Code outlines the homeowner’s requirements to qualify for this protection: 1. Contract with a real estate developer, contractor, or factory-built housing retailer who is properly licensed or who is legally exempt from licensure. 2. Execute a written contract between the homeowner and the contractor. The written contract should inform the homeowner of his or her rights under this Act. 3. Pay the entire contract price, including any amendments to the contract. 4. Occupy the residence as a primary or secondary residence within 180 days from its completion, or rent it to a tenant or lessee who so occupies the residence. If a mechanics’ lien is filed on a property, the Act requires the lien holder to present the homeowner with an Answer, Affidavit, and Motion for Summary Judgement form when the lien holder initiates legal action to enforce the lien. If the lien holder does not provide the form, the lien is unenforceable. The Answer, Affidavit, and Motion for Summary Judgement form includes simple instructions on documenting the necessary information in order for the homeowner to be released from liability under the lien. In anticipation of the possibility of having to complete one or more of these forms, homeowners are encouraged to keep copies of the following on file: 1. The written contract for the construction of the work, which includes the contract price. 2. A Custodian of Record showing that the original contractor was licensed.
