Landmark Ruling Patents on Genetically Engineered Organisms OKd terium that eats oil. The question now is where the court is going to draw the line, commented Frank Hubard, patent expert for the National Science Foundation. He said it was still too early to assess the full ramifications of restricting the right to create specific forms of living matter, but noted that the bacterium bear very little resemblance to life as Peter Kieman By Reuters News Writer The question of genetic engineering has moved out of the laboratory and into the courts with a landmark ruling here that patents can be taken out on genetically engineered organisms. ! The ruling came Thursday when the Court of Customs and Patent Appeals overturned a previous decision and said General Electric could take out a bac patent on a laboratory-create- d WASHINGTON we know it. If the court restricted its decision to patents on such simple life forms, Hubard said, the ruling would cause few problems. If it expands (its ruling) to higher forms of life, then the results could be quite dramatic, he added. The ruling reversed a unanimous decision by the Board of Patent Appeals which argued that Congress never intended live organisms could have patents taken out on them. The organism in question was described by a General Electric spokesman as a modified natural microbe. In essence, it is a hybrid of four other microbes which occur naturally and that digest different hydrocarbons in oil. iSjLlL In writing a concurring opinion on the ruling, Chief Judge Howard T. Markey said that the only issue before the court invention was whether a man-mad- e was patentable or not because it was alive. There were only two sources for manufacturing matter. They are God . . . and man, he wrote. Since the bacterium in question was it therefore falls definitely man-madsquarely within the language of the statute. m fects of doing one thing or another, then we must be flexible enough to take the Isnt answers to tax questions?
