HENDERSON, a native of West Virginia, and a Utah resident for over 32 years describes himself as a frustrated farmer. Mr. Henderson served in the U.S. Army in the Korean War. Mr. Henderson is an employee of the Union Pacific Railroad Company where he works as a crew' dispatcher, calling the crews for the trains. Mr. Henderson supports the American Parly platform. He supports the Constitution of the United States as originally ratified. He supports property tax relief, private schools and a voucher system in public schools. What background do you have to qualify you for this position? 1. I have been involved in the general practice of law in Davis County since 19. 2. Through my experience as MR. Mrs. Gibbons is a member of the Utah Finance Officer Association, Women Official Ludeen Goodfellow Gibbons, incumbent, is seeking the Republican nominee for the office of auditor of Davis County. She has held this post for the past four years, and prior to that time she served for three years as chief deputy auditor. MRS. GIBBONS has had a total of 29 years of auditing experience, with ten of these W hat background du you have to MR. SAUNDERS is a resident of Clinton, having served two terms as mayor of that community. He is a graduate of Weber State College and BYU with a degree in business education and economics. He was a public educator for 14 years and a past president of the Utah Business Education Association. He still maintains a general contractors license even though his business has been inactive since his election to the commission. He is a veteran, having e served in the Army Corps, and has also served as an LDS bishop and high councilman. qualify you for this position? I have a degree in accounting and office management. 1 have been the Davis County Clerk for twelve years and worked in the Clerk's Office for John M. Park three years prior to my being elected in 1970. I have the experience, knowledge of the Clerk's Office and the ability to carry out those duties and responsibilities. It is vital that the citizens of Davis County' have experienced, responsible, knowledgeable and dedicated persons in County offices. I believe there are additional sources of revenue for Davis County Schools, but it will take a well informed citizenry to help elected officials decide which of the following alternative sources would be the best: better enforcement of existing tax laws and tax collection; better management and utilization of state school lands; enforcement of payments for mineral leasing on federal lands: equalization of voted leeway: severance tax on minerals, corporate franchise tax. stronger cooperation between industry and the schools; expanded use of volunteers. and increased classroom productivity. Utah is in the enviable position of having relatively few administrative problems in our trial courts. The State Judicial Council, a problem stud) ing and policy making body composed of members from all levels of the judiciary has an administrative arm in the State Court Administrator and his staff. Also we are assisted by local court executives so that judicial time and effort are directed toward judicial functions. Since our sv stem has resulted in substantial betterment of our received national recognition. But certainly with population growth and increases it has in work loads we must and will continue to address and hopefully improve areas of administration. What role do you think a judge should take in law enforcement? Our constitutions provide for three coequal branches of government. viz. the Judicial, the Executive and the Legislative. Clearly a judge is an officer of the Judicial Branch and a Peace Officer is part of the Executive- - Branch. It follow s then that a judge has no direct authority over law enforcement officers. However, in the broader sense, the judge must apply applicable law and impose proper sentences taking into accent the fact and circumstances surrounding each individual case. Loren D. Martin What difficulties do you find in court administration? Unfortunately, courts appear to have lost sight of their objective and reason for being. Technical rules of procedure seems to have more importance than the primary responsibility of truth finding ancl the administration of speedy justice. There are fine, excellent hard working judges. However, some judges feel little responsbilitv to the public and have an aloof attitude that does not permit criticism. They must be required to stand up. justify their actions and explain what happened to their stewardship. Now is the time for the public to judge by exercising their franchise. What role do you think a judge should take in law enforcement? The judge has the first responsibility of ensuring that both sides have a fair trial. His or her responsibility is not just to the defendant but also to the public prosecutor. Both are entitled to a fair hearing. Then, if a person is found guilty, the duty shifts dramatically and instantly. The judge becomes the spokesman of the community, public and victim. The judge then is the chief person hearing the responsibility of prevention of criminal conduct. People in possession of drugs SfcOqld be at least questioned as to where they bought it.
