Show COPPS LAND REVIEW homans womans rights bights under the homestead laws washington DC july 1 1888 editor deseret news unmarried women widows maidens i and deserted wives who are over the age of twenty one years are e entitled n to all the rights privileges and benefits under the homestead laws that can be enjoyed en joyed by men the mother of a living child or children whether widow deserted wite wife or unfortunate single person may acquire title to land as the head of a family thoung under the age of twenty one widows of deceased entry men succeed to the rights of their husbands and may make final proof and take title in their own names it is not absolutely sol necessary that they should reside upon the land after the death of the husband as residence or cultivation for the prescribed time is all that is demanded of widows and minor heirs the widow of a person who served for ninety days or more during abe war of the rebellion Keb elliou in the united states army navy or marine corps and died without makins making an entry may make an entry the same as her husband it if living might do and in making final proof receive credit in lieu of residence on the land for the period of the husbands service not to exceed four years the deserted wife of a homestead entry on tryman main may make linal final proof as his agent and have patent issued in the name of her husband or she may con test teft his entry on the round ground of abandonment of the claim aini and after cancellation enter eater the abeland land in her own no name me the latter is the wiser course for many reasons an unmarried woman widow or otherwise having initiated an entry may marry without affecting her right to the land provided she complies with the legal requirements should she marry prior to the time she might make her proof and perfect her claim and leave the land to reside with her husband elsewhere the entry would be liable to cancellation for abandonment but not on account of the marriage where a man and a woman each make a homestead entry and marr marry y before making final pro proof f one of the entries must be relinquished or commuted at their choice if they live to gether on oa one homestead the entry covering the other homestead will be liable to contest for abandonment even though the land be cultivated and improved the homestead law requires three things to give final title first honest residence second good goo cultivation to crops or otherwise and third fair improvements in the matter of buildings bui ldina fences and the like corn com aliance with only one or two of these rea requirements will not satisfy the law full M compliance with all three requirements must be satisfactorily shown for the entire period at the date when the final to made the daughter of a deceased soldier sailor or marine if otherwise qualified may enter land in her own 4 galt notwithstanding an entry may have been made by her guardian and aad per fectea tor for her benefit during her mi bority she fhe can thereby secure two homesteads A widow as the legal representative of her deceased husband may continue to cultivate his homestead and at the same time make an entry in her own name A woman has this advantage over ever a man she can thus secure two homesteads while he h is allowed only y one the widow of a deceased entry maa may purchase purchases under abe act of june 1880 the land embraced in a homestead entry in cases where that act is applicable HENRY N COPP |
