Kane Casein( ORDERVILLE, E.iza Olive Allen Cox. 87, Orderville, u I- name z N Plaintiffs in a lawsuit involving Mountain Fuel Supply Tuesday they will change the content of their complaint but retr in its trust. The plaintiffs dropped charges against the utility, but their complaint still will involve MF.S. Richard Nemelka, lawyer for the plaintiffs, said the amended suit will cite the Utah Public Service Commission as its only defendant. It will ask the judge to rule that all rate increases granted by the commission without a public hearing are illegal. In addition, piaintiffs will request a ruling that the PSC must order MFS to return $31 million collected through rntes increases granted without public hearings. Nemelka said the amended cemplaint will be filed in Third District Ceurt late this week or early next. The plaintiffs will remain the serne. They are Wayne liorrocks, unsuccessful candidate for City Commission, the Utah State Coalition of Senior Citizens and nine state legislators. "There were procedural problems with retaining Mountain Fuel as a defendant," said Nemelka. "So, the complaint will be specifically altered to exclude the utility, but it will ask the Public Service Commission to order the refund." "The purpose of the lawsuit," explained Nemelka, "is IC) get the procedure declared illegal where the Public Service Commission allowed rate increases without public hearings.
