Salem, 34, of Sioux Falls, S.D., was the only court member selected during the Saturday session. At least five jurors are needed to complete the jury. Failure to achieve the minimum necessary postponed the scheduled start of trial testimo Col Reid W. ny Monday. Kennedy, the military judge, ordered the prosecution to have seven prospective jurors ready to be questioned Monday morning. He adjourned the Saturday session at 10:40 a.m. after the prosecution had excused Maj. Nelson 0. Newcombe of Auburn, Maine, and the defense had thrown out Lt. Col. Richard W. McKee of Tampa, Fla. The prosecutor, Capt. Aubrey M. Daniel, requested that the court remove Salem because Salem had said under questioning when he first heard of the Calley case, he thought a man would have to be berserk to kill more than 100 persons and that his men would have prevented such an "insane act." The judge denied Daniels' motion, saying it was evident Salem had presumed the charge was that Calley personally killed 102. The government has said it intends to prove the murders were committed either by Calley or subordinates under his direction. Salem testified he had served as a platoon leader in a line company that searched through Vietnamese villages and picked up men, women and children for return to headquarters for questioning. Three senior officers were chosen as jurors Friday, and two other officers tentatively selected. There remained to be questioned, before noontime adjournment for the day, only two more prospective jurors seven an extra from called up Friday afternoon. Fourteen officers had been examined in two days of efforts to complete the court, which sits as a jury. It will decide the first fate of the lieutenant of infantry who led his platoon on a sweep through the subhamlet of My Lai on March 16, 1968. e He is charged with murder and faces death by a firing squad or life imprisonment if convicted.
