Anyone having knowledge of the whereabouts of an animal known to have or suspected of having rabies shall report the facts immediately imme-diately to the local health officer. of-ficer. Every dog or other animal which has been bitten by or exposed to any animal suspected to have been infected with rabies shall be forthwith seized and taken by the City Marshal or any law enforcement officer and securely se-curely and separately impounded impound-ed and not permitted to run at large. All such animals shall be immediately vaccinated regardless re-gardless of previous vaccination vaccina-tion and quarantined in a suitable suit-able place or at a licensed veterinarian vet-erinarian hospital for a period of fourteen days. It shall be the duty of the City Marshal days, after which the animal must be disposed of in an appropriate ap-propriate manner or if a dog vaccinated before release, in accordance with this ordinance. If an animal dies or has been killed, a report thereof shall immediately be made to the health officer and the head shall be immediately removed and transported to the State Department of Health for study and for examination for rabies. Section 9. All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 10. If any part of this ordinance shall be held unconstitutional or void, such part shall be deemed severable from the other part, and the invalidity thereof shall not affect af-fect the remaining parts of this ordinance. Section 11. Any person violating vio-lating the provisions of this ordinance shall be deemed guilty of a misdemeaner and upon conviction thereof shall be punished by a fine of not less than $25.00 or more than $250.00, or imprisonment in the City Jail for not more than thirty days, or by both such fine and imprisonment. Section 12. This ordinance is hereby declared to be an emergency measure and shal. be in full force and effect from and after its publication. Voting Against: None. Pub. Feb. 13, 1964. ORDINANCE NO. 108 AN ORDINANCE PROVIDING PROVID-ING FOR THE VACCINATION OF DOGS, AND PROVIDING PENALTIES FOR THE VIOLATION VIO-LATION OF THE PROVI-. PROVI-. SIONS THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MILFORD, UTAH: Section 1. It shall be unlawful un-lawful for any person to keep, own, maintain or harbor any dog over six . months of age within the corporate limits of the City of Milford unless it shall have bten vaccinated as hereinafter set forth, and within with-in two years from the date a license applied for expires. Section 2. Any person owning, own-ing, keeping or harboring a dog over six months of age within Milford City, who shall hereafter apply for a certificate certifi-cate of registry, and a license for said dog, shall furnish to the City Recorder a certificate of vaccination showing the name, breed, color, sex, coat and any identifying marks of the dog for which application is made, and the date and by whom the vaccination was done. Section 3. The vaccination of a dog shall be accomplished by an inoculation with anti-rabies anti-rabies vaccine, having an effective ef-fective immunity of at least three years, and administered under the direction of a Public Pub-lic Health Officer of Milford City, or a Public Health Officer Of-ficer of the State of Utah, or by a licensed veterinarian under un-der the direction of such public pub-lic Health Officer. The vaccine vac-cine used shall be approved by such Public Health Officer and the Veterinarian's Association. Section 4. Any person owning, own-ing, keeping or harboring a dog over six months of age within Milford City, who has heretofore applied for and been issued a certificate of registry for such dog after paying pay-ing the license for the calendar calen-dar year 1964 as required by the ordinances of Milford City, shall have such dog vaccinated as in this ordinance required within 16 days after the effective effec-tive date of this ordinance. Section 5. The provisions of this section shall not apply to non-residents having dogs under un-der restraint within the City to notify the Public Health Officer of every such animal impounded. If, after observation observa-tion under the supervision of the Public Health Officer for such period, any such animal is adjudged free of rabies, the owner may reclaim the animal, upon payment of the regular keeping fees, the cost of the vaccination and upon compliance compli-ance with any other licensing requirements. In the event that any animal under quarantine quaran-tine is diagnosed as being rabid, it shall be disposed of only under the orders and direction di-rection of the Public Health Officer in his absolute discretion. discre-tion. Section 8. A dog which is known to have bitten or injured in-jured any person, so as to cause an abrasion of the skin, or a suspected rabid dog, shall be placed in confinement under un-der the observation of a veterinary veter-inary hospital or suitable pound, and shall not be killed or released until at least 14 days after the onset of symptoms symp-toms suggestive of rabies. Any animal of a species subject to rabies that has bitten a person shall likewise be confined and observed for at least 14 days. Under no circumstances should a dog or other animal suspected suspect-ed of having rabies which has bitten a person or other animal be killed. Such animal shall be impounded and held for observation for a period of 14 |
