Show JUDGE LEROY H. COX HEARS IMPORTANT CASE AT RICID7IELD Judge LeRoy H. Cox went to Richfield Rich-field Monday and on Tuesday, in the absence of Judge Bates, who is in St. George, took the bench in the sixth judicial district court. The first case heard by Judge Cox is heralded as of vital importance to sheep raisers, as it involves the issue of whether an oral contract is binding upon all parties concerned. The case, that of the alleged delivery of 260 head of lambs, came up before Judge Cox on demurrer to the original complaint com-plaint by the defendants. The plaintiff alleged delivery and tender of the lambs which were refused. re-fused. The 260 head had been orally contracted for at 12 cents a pound on foot, the complaint alleged and involved in-volved the sum of $2815.76, it is set forth. The court ruled that the demurrer to the original complaint stood, but gave the plaintiff ten days in which to file an amended complaint. |
