Show Convicted Gibson Sentenced to Five to Life An extra long session of District Court was held Tuesday, Tues-day, Oct. 12, with Judge Edward Sheya presiding. In addition to regular law and motion matters,' 15 criminal cases were on the calendar for arraignment, trial settings and sentencing. Charles Lee Gibson, who was recently convicted by a jury of criminal homicide,' murder in the 2nd degree, was sentenced to serve a term of not less than 5 years and which mav be for life in the Utah State Prison. Sheriff W. H. Bowman was ordered to convey him to the Warden or other proper officer at the prison.-Court-appointed defense de-fense attorney, Harry E. Snow, stated he would appeal the case to the Utah Supreme Court, stating that testimony about alleged rapes following the murder should not have, been allowed. The probation of Delford Hotz was revoked for several admitted violations, and the defendant was sentenced to a term in the Utah State Prison not to exceed five years. Michael Eugene Hill and Mitchell Oliver Hill were each sentenced by Judge Sheya to ' pity's fine in' the sum of $500 each with 3 years probation on assault charges. William Pitchford was placed plac-ed on 3 years probation on an arson charge provided he makes restitution in the sum of $1500, and receives regular treatment from Alcoholics Anonymous. Robert Hotz, after having undergone a month evaluation evalua-tion by the Board of Corrections, Correc-tions, was given a 3 year probation upon specified conditions. con-ditions. The other criminal cases were set for trial as follows: State vs. Max Woodward, June 12, 1977. State vs. Eddie Green, Dec. 2, 1976. State vs. Pat Unger, Jan. 27, 1977. State vs. David Earl Hotz, Feb. 17, 1977. State vs. Larry Vijil (to be set next Law and Motion day). State vs. Dennis Bailey, Feb. 1, 1977 and 2nd case set for Feb. 3, 1977. State vs. Mark Gramlich, Mar. 23, 1977. aiaie vs. 10m nowara Balsley (to be set next Law and Motion day). Probation was continued in the State vs. James Chmielew-ski Chmielew-ski on condition he pay the balance of $450 owing on his fine at the rate of $50 per month. In addition to the above matters, the court granted the adoption of Ellen Arlene Hopkins; appointed a guardian of the person of Frank Cameron Murray, and discharged dis-charged the executor in the estate of George J. Patee; approved the final accounting and ordered distribution in the Estate of Ralph E. Hawks. Judge, Sheya granted the following divorces: Sheila Robinson from Clyde Lee Robinson; Douglas L. Carrithers from Judith L. Carithers; Charme Sheets from Timmy W. Sheets; Renann Nelson from Wesley E. Nelson; Beverly Vickers from Richard Lee Vickers; Karen Bierschied from Joe Dell Bierschied and Florence A. Roberts from Kenneth G. Roberts. In the case of Gloria Jean Reedy vs. Dallas D. Reedy, the court modified the decree to provide for divided custody of the child of the parties based upon their stipulation. |
